Hi, all, followup question to some of my previous about I-130/I-485 for parents.

 

I concurrently filed the I-130/I-485 last week (5 business days ago), UPS'd overnight and delivery confirmed. I still haven't gotten any G-1145 e-Notification for anything. My beneficiaries only have three weeks left on their I-94s. Should I prepare to have them leave the US if we don't get a receipt or acknowledgement from USCIS that they have accepted the applications? Is there AOS-pending status good as soon as the delivery is signed? Please help me not to panic. :)

I just filed on the 1st after my I-94 has expired by a month because we wanted to file our taxes before sending in the AOS paperwork. I'm on a K-1 so it's kinda different though when it comes to overstay. It took them like a week to cash the check and I received my hardcopy NOA1s today. Hang in there. They don't need to leave. Besides, they still have a valid and unexpired I-94.

ROC filed on December 1, 2020, assigned to SRC, approved within 106 days on February 18, 2021.

I-94 does not expire. My wife arrived 10/12/18 on K-1 visa and we married in November. Her I-94 was an online-only document, which she did not receive until she showed up for a follow-up exam at the local department of health. It's only a document verifying arrival in the U.S. and it does not expire. It really does not even require but a copy for your records, as their is no hard copy of it anywhere but online and (later) in file packages you send (such as I-485 for Adjustment of Status). Put that one out of your thoughts. Concentrate and follow your account (if you took one out yet) on USCIS web site.

I think they meant the expiration date on the I-94, which indicates the last date you are permitted to stay by ("admit until date"). The paper/printout itself does not expire, but the validity of status does.

Sorry to piggyback on this topic but was a very similar question so did not start a new thread. Hoping to get some answers here.

 

I concurrently filed for both my parents in late December,2017 who are visiting me currently. They have 10 year multiple entry visitor visa which got stamped for 6 months of stay and expires in May. Now, as per the recent trends, it may take 6-7 months for their green cards to get approved which will be in June or July. So do I need to get their visitor visa extended ?
