This is risky. The reason she was issued a visa was for that purpose. If she gets to POE and tells them she’s going when she’s not going she will be lying and that is misrepresentation and when she gets caught for that she will get a lifetime ban. If she tells the truth there’s a really big chance of her getting denied entry. She should reapply or go to the damn camp then go visit during her time off.

Imagine she gets to POE, CBP looks at the annotation and asks to peek at the return ticket which would now be for two weeks later. Would the officer not be suspicious?

The annotations she got in her Visa are restrictions to that visa. The reason she didn’t get a student visa is because that school and the program she’s going to probably do not qualify for a student visa thus she gets a visiting Visa with an annotation. That annotation needs to be taken seriously because it’s there for a reason. Shall she try to deviate from that she could get into serious trouble. If she ever wants to get back into the US in the future, she’d better not lie to immigration.

Nobody's brought this up yet, but is this friend a romantic interest? The assumption would then be that she intends to marry and/or file for AOS (or overstay). The added challenge being that if you were to file for a benefit later, then it will shine a spotlight on the visit and if misrepresentations were made to the CO/CBP.

Mykyta is a male Ukrainian name, so it seems as it could be a romantic interest.  This whole thing may be legit but is often a scam tactic in Ukraine.  B2 visa is difficult to get in Ukraine and there is a reason for it.

Good to know...I had no idea. haha But I said "romantic interest" to be gender-neutral...same-sex couples and all.

I’d be pretty certain that with an annotated visa not only would they look at the ticket but they’d also expect her to be able to show confirmation of her plans from the language camp, the homestay etc etc.

Everyone here has pretty much already said it, but - it's a high risk of inadmissibility or worse (a ban).

 

My fiancé has visited the US before from Sweden, with a valid passport, to attend a hockey game, and the particular CO he got questioned tickets, dates, even the teams playing (possibly to validate the game was real). You never know what kind of questions they may ask or what train of thought they may have based on the information provided. Lying to a CO or attempting to enter the country under pretenses different from those annotated on the applicable visa could be grounds for much worse than denial on the spot - they could be banned from visiting the country in the future. Not to mention, you just generally don't want to run the risk of having a bad experience with immigration before even entering the country. Something like that can follow a person in future endeavors.

 

Take the time to reapply for the applicable visa.

Your friend should re-apply for a B2 visa without the annotation.  Using a visa for a purpose other than that for which it was issued is a risky gamble.  There is a 100% chance that the CBP officer will ask her the purpose of her trip. Remember-  This is a permanent record.  There are a number of scenarios in which this history might be recalled and/or used later.  Once misrepresentation has occurred, it is a clicking time bomb......as evidenced by some posters here on VJ who have suddenly found themselves with no path to the US for many years and longer.

 

Don't take the chance.......keep it simple, straight forward, and legal.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Is the language camp even in the same area that the friend wants to go visit? Going to be pretty hard to try and sneak on by if the places aren't even in the same location.

People think they can fool the immigration officers at POE, I lived in a border town (which I hope my husband and I can return there someday) and I have a friend who's mother is an immigration officer at the border. They catch people all day long with lies.
