Reason for expedite visa

Hello everyone,

I recently filed for k1 visa. I am at my late thirties of age and I have cerebral palsy since I was born, so in my religion and traditions there is no way my fiance can have a contact with me before we can get merried. Given that, I am thinking is it possible for me to ask for expedite visa ? Because I honestly start loosing hope of conceiving or giving birth to a baby at an older age and having these health problems and as you know  the dream of every woman to be mom.

Do you think it's a good reason? I would appreciate your input.

(Un)fortunately, you will have to meet your fiancé before filling your K1 visa if you'd like a speedy approval.  A waiver for not meeting in person is going to take more time, not less, and is rarely granted.

 

One of the benefits of meeting in person is that you can start to try to conceive, if you'd like to expedite the pregnancy. Or get married and start trying, then file for a spouse visa.

I have to agree with @Lemonslice on this one. Not meeting due to religion or traditions is not means and is not valid for a expedite, in fact it will more than likely mean a denial if you go this route. Not meeting in person is due to religion has been proven on here by other people that tried to go this route that it will lead to a denial of the K1 visa. Even if you are a conservative Muslim or Christian you can still meet each other if family is present and that has been backed up on here by many other posters. Best of luck to you.

I have met my fiance in person before I filled for k1 visa but in my religion and traditions we are not allowed to have a sexual contact before we can married. So there's no way for me to conceive and I have to wait for the k1 process so my fiance can come and we can get married.

I am asking due to my health problems and possible difficulties of being pregnant at an old age is it possible to ask for expedite visa?

You can try to expedite due to health reasons, but also be prepared for that expedite to be denied. Sometimes they are approved, sometimes not. Difficulties of pregnancy at an older age are not a valid reason to expedite, so I wouldn't include that in the proof that you will need to submit to USCIS in order to try to expedite. 

 

Others have suggested the CR1 visa, which might be a good idea in your case. Your fiance can come and marry you in your country, you can try to conceive during that time after the marriage, and then he returns home and you file a CR1 petition (spousal visa). CR1 petitions currently are taking around 12-14 months to be processed, which isn't even that much longer than current K1 processing times (around 8-11 months).

Ahhh ok that is more clear thank you. You can definitely try for an expedite it will not hurt anything at all.

I would be very careful about using age and difficulty of getting pregnant as a reason to expedite. Those 2 reasons you want to use to expedite  are also red flags in some countries.

Your CP does not have to do with anything but your motor function.

 

The religious grounds may be a factor, but it is a very long shot. I would not waste time with this avenue ether.

 

Do meet in person, as much as you can, the more the better. It is good both for the official process and for personal reasons.

 

The most alone you will ever feel is when you are with a wrong person. Do make sure that you are with a right person. Your responsibility is to bring children into a happy family.

Good advice from other people in this thread. However, I do not believe that getting pregnant is grounds to expedite at all. Otherwise everyone would be claiming pregnancy. Expedite is more for thigs like imminent military deployment.

You can certainly try to expedite, but I'm not sure where your need fits in these criteria:

 

  • Severe financial loss to company or person;
  • Emergency situation;
  • Humanitarian reasons;
  • Nonprofit organization whose request is in furtherance of the cultural and social interests of the United States;
  • Department of Defense or national interest situation (These particular expedite requests must come from an official U.S. government entity and state that delay will be detrimental to the government.);
  • USCIS error; or
  • Compelling interest of USCIS.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..
