Timeline

Did you have to live in Manila during the treatment? My fiancee is from Cebu. We can't afford to have her stay in Manila for 6 months. She has her job in Cebu and have to take care of her mother.

Mon - Fri  she has to be at St. Luke's to take the medication .. for 6 months.

You can do it in cebu but it  adds one year in addition to an already long 6 month process

Thank you for the reply. When you say it adds one year to the process, what does it mean? I have to reapply again? Submit K1 all over again after 18 months? Or have her tested again 18 months later at St. Lukes? Postpone the Interview at the Embassy 18 months later? Inform St Lukes after 6 months of treatment in Cebu?

If you complete the TB treatment outside of SLEC, then inform them after the 6 months ..  If I remember correctly SLEC is then required by CDC to have you wait one year before they have you complete a new medical (and SPUTUM).

 

The embassy only extends the petition from USCIS for up to one year .. which may mean you have to complete a new petition process.    Can't say for sure how USEM will handle this.

It means you would undergo full treatment (6 months at best), then there is another 1 year waiting period in accordance with CDC guidelines.

I thought others noted USEM would extend the I-129F validity in this case, but I cannot say this with full confidence and therefore would not depend on this unless somebody could verify it.

 

That said, if the plan really was to do the treatment outside SLEC, there's nearly* no good reason not to just start over by getting married and doing a CR-1 spousal visa. This visa is superior in virtually every way, and the wait would no longer be an issue with the mandatory 18+ month treatment + waiting period.

 

*One notable exception is where you are unable to marry anywhere outside the US, or if there are immigrating stepchildren that would be aged 18+ at the time of marriage but still be under age 21 by the time the K-1 visa gets issued.  That's an incredibly narrow margin in this circumstance, but possible. In that case, a K-1/K-2 would be needed for the children to immigrate with the K-1 parent.

Thanks again for your reply. My problem is that I cannot get marry in the Philippines again. I am divorced in the USA but still legally married in the Philippines. I wonder do others have this problem.

One option - if needed - is to marry outside the Philippines. There's no requirement that the marriage for a spousal visa must be within the beneficiary's country of citizenship or residency.

Most accept that they complete DOT at SLEC for 6 months, then complete the visa process once the medical is completed.

 

FYI - you can get your divorce recognized in the Philippines (if you had been married to a foreigner).

Thank you all for your replies. My fiancee and I cannot afford for her to stay in Manila for 6 months as she still has to take care of her mother in Cebu. She doesn't know anyone in Manila.  So if she fails the TB and Sputum test, we have her treated in Cebu and reapply again a year later. It is what it is.

 

As for marrying in another Asian Country, I'm not sure which other Asian Country is the easiest. Getting your divorce to be recognized in the Philippines if you were  married there before is time communing. You have to hire a lawyer and petition the Philippines Court to record the divorce so they can enter it to the Cenomar. It could take up to 18 months to go thru the process.

Getting Married in Hong Kong is very simple.   Send the paperwork in 2 to 3 weeks before and  then go for a few days to complete.  You can even do the report of marriage there at the Philippines Consulate to save the hassle in PI.   We got married and Cotton Tree Registry and it was "very beautiful and romantic" - quoting my asawa.
