Hey everyone, my husband has been in the navy for almost 8 years now. We’ve talked about me joining the navy as well (he is fts and I would try to get a fys job as well). I’m still waiting for my 10 year GC (filed early feb. 2017). Can I still go to meps and enlist or should i wait until I have my new GC in hand?

On November 16, 2018, Judge Jon S. Tigar of the U.S. District Court Northern California granted a preliminary injunction titled, “ORDER GRANTING CLASS CERTIFICATION, DENYING MOTION TO DISMISS, AND GRANTING PRELIMINARY INJUNCTION“. The order’s conclusion reads, “For the foregoing reasons, the Court (1) GRANTS Plaintiffs’ motion for class certification; (2) DENIES DoD’s motion to dismiss; and (3) GRANTS Plaintiffs’ motion for preliminary injunction. The Court hereby ENJOINS Defendants and their officers, agents, servants, employees, and attorneys, and any other person or entity subject to their control or acting directly or indirectly in concert or participation with Defendants from taking any action continuing to implement the October 13 Memo and ORDERS Defendants to return to the pre-October 13, 2017 practices for the accession of Lawful Permanent Residents into the military. This Preliminary Injunction shall take effect immediately and shall remain in effect pending resolution of this action on the merits or further order of this Court.”

Another update. The DOD has appealed the judge’s injunction. They have filed a motion to keep the policy in place until a decision is made.

That's really helpful to know.

So what's the word on the second issue that was part of the 2018 changed rules that got reversed regarding when you can get your N-426 Certification of Honorable Military Service?

Background: Before rules change (and hopefully now) you can get this document one day on active duty after basic training. The 2018 rules change made it a 180 day active duty requirement to get the N-426, which is needed for N-400 naturalization documents.

And also, was a more simplified background check have to be successfully completed before getting ship out to boot camp orders?

Thanks to all those immigrants who are serving !!!  Really want to hear what you know on these moving target subjects.

I honeslty have not found a clear answer abkut naturalization. My recruiter thought Id be naturalized by the time I leave bootcamp, now I know that's not true anymore, even tho we are still in time of war. Then i read somewhere you need to be on active orders fir a 180 days (which, my training would be)... but i just hear different things. I will bring my documents. And just see.

I am not sure what the background check actually entails,  i know they have contacted my employers. I also know that i had to have a shipping day 120 days (if I remember well) after I swore in where some citizens here can ship out way earlier.

I have been doing research myself for my son who comes to the USA in 2 weeks as 10 year GC immigrant and just talked with several different service recruiters in person: looks like boot camp plus completing tech training is when you can get N-426 needed for N-400 naturalization document submittal.

Please write back when you find out about your N-426. This is all a moving target so getting real information like yours is very helpful for our green card service members.

The background check should not be needed for your N-426. It is for other purposes.

I am in the same situation , I will be shipped to basic training soon and I have no idea when I can get the N-426 certified so I can apply for citizenship , I am also afraid since I am on conditional gc that my GC will be expired before I get citizenship

You file I-751 to remove conditions on your gc.  You can do that 3 months before and up to your gc expiration date.  You get a I-751 NOA1 document back that gives you an 18 month extension.  Let us know when you learn when you will get your N-426 military honorable service document that you will need for your N-400 naturalization document submittal.

Guys, any updates on it? I enlisted on April 15, 2020 and I'm getting shipped out on June 3rd, 2020. My recruiter keeps telling me that I need to have my N-400 and N-426 on me when I get to the base. She also said I will be naturalized by the time I graduate Basic Combat Training. I'm so lost! Does anyone know something new about it? All I read is conflicting information and today I called USCIS and the agent confirmed me that I can apply right away when I get there.
