We received notice from the NVC (March 9th) that the embassy approved our expedite request, for our application which was originally sent May 2017. We requested because our daughter is aging out in weeks, and from what we understand, has to be "feet on soil" in the US no later than her 18th birthday to qualify for citizenship (I am a US citizen petitioning for her). My questions are:

1 - Am I correct in that she HAS to be feet on US soil by her 18th birthday to automatically qualify for US Citizenship, or is there some type of "exemption" or other that I don't know about yet?

2 - Any ideas as far as timeframes for the documents to be received by the embassy from the NVC? And embassy processing times - as I am quickly running out of time (see point 1)

3 - When and where do I get notice (now that this has been expedited, and I am only supposed to deal with the embassy as the NVC has told me) for fees to be paid - and how do I pay them? At the embassy at the time of interview, will the embassy send me an email (or something) to pay online or elsewhere before the interview, or what - as the NVC/embassy has expedited the case prior to me submitting any other docs (Aff of support, 260, etc)? They have just told me that the case is being forwarded to the embassy "immediately."

4 - Should I still submit required docs to the NVC, or will they be sent to the embassy, or do I bring all to the interview appointment - or...will the embassy direct me to do something totally different.

5 - I created a profile with Do I bring all documents with me to the embassy at the time of the interview, or do I somehow submit them before?

6 - Are there any fees for the medical exam and biometrics? When and where are those paid?

7 - Does the embassy in Dominican Republic set up the interview appointment, or do I do it somehow/somewhere?

 

Thanks for your help clearing up this confusion.

yes, she needs to be in the us before she turns 18

 

even with the i130 expedited, if she is turning 18 in weeks, there is no way that she can be here before she's 18. she will have to go the normal route. be a resident for 5 years and apply on her own for citizenship

Even if the delays were cause by USCIS, NVC, weather, shutdowns, etc -

Also, I have heard that in some cases the age gets "frozen" to the age of the individual at the time of approval of the I-130 by the USCIS. Is that a possibility, or not that you know of?

Nope aging out is for just receiving a green card not citizenship. You left it too late I’m afraid.

that has nothing to do with citizenship. if she doesn't get here, she doesn't get here. she will become a citizen after 5 years

 

the freezing of age has to do when you file for a GC before your child turns 21, the age freezes and the minor child of a USC will receive the GC as a minor even though they turned 21.

  1. Yes. No exemption to this. And it will likely be more than a few weeks before it goes through NVC, the embassy, issuing of the visa, etc. even if everything goes well (no NVC checklists, no AP or 221(g) after the interview, a clean medical, etc.). It's possible if everybody rushes it and there are zero issues, but it's far from likely.

That's processing times...not really a "delay". Anyway, the answer is "no, it won't matter".

That's for CSPA to qualify for the immigrant visa, not deriving citizenship.

So - if that is the case, why would the embassy even approve the expedite if there is absolutely no way for this to complete. It was expedited the day after I sent the email requesting the expedite. It feels like there was no point for the embassy to approve the expedite.

 

(I just want to also say thanks for all the friendly responses here. Y'all have been alot more helpful already than the embassy has been to this point - who has told me repeatedly "wait for further instructions" without answering any questions whatsoever.)

Well, the chance was 0% if they didn't expedite. Like I said, it's possible to make it in time, which is a heck of a lot better than no chance.
