I might be mistaken but I believe in her case it would be an F2B visa. :)

no, i think that was one option suggested. OP is from germany, who is going to be studying in germany first before moving in with her significant other (who is an LPR) after her graduation. she asked if she is able to visit while her immigrant visa is being processed. i said what i said because if she overstays during her visits prior to immigrating, then the overstay may have negative consequences because her significant other is still LPR. if her significant other is USC then it will be a different story and the overstay can be forgiven.

Edit: ok, i just realized, F2B is family based (duh, for me). but still, regardless of what visa she immigrants on in the future, it doesn't negate my advise, that she should not overstay any visits to avoid complications.

They can’t file for CR1 cause he’s only LPR. Have to be USC to file for CR1. And yes, don’t overstay even for a second or it will be denied. They don’t forgive overstays for spouses of LPRs.

Its me. I wasnt able to quote or comment anymore on my other account for some reason. So for what kind of Visa do I have to apply for then?

F2A. If you started studying just now (last October), you will be busy for at least another three years. Most people take longer. Being from Germany and being a student gives you the advantage to have strong ties to Germany and being able to get a lot of visas to spend more time with your significant other. You don't have to rush into anything like most people have to who come from a high-fraud country. Do your praxis semester in the U.S. on a J1 visa.  Or if you're willing to pay a lot do a semester abroad on a F1. After only meeting twice you don't have to rush into a marriage if you have plenty of time to figure things out (3 years).

On a side note. I had my fiancé in the US and never had a problem being let into the U.S. Being enrolled in school is good proof, get a working student job which is proof too. I always carried letters with me from my professor that I need to return to Germany to finish my Master thesis with him and a letter from my employer that I am still under contract with them. No one ever wanted to see them but they asked me about it. Didn't even have problems after I was there on a J1 (internship) and B1 visa (volunteer for a NGO).

Oh okay. Yes I know what you mean. I would be doing a semester abroad at a partner university of my university. They would pay all the study fees and an other thing called Auslands Bafög would help me out with other expenses, like flight or livings costs. At least this is how my plan looks. I know that I have time, it is just that the longer we take to decide, the longer we would have to wait for the process to be done and since he is not a Citizen it can take a while (up to 2 years for the process alone). I would start with uni this October and I want to only finish my Bachelor here. My plan would be to marry next year. There is a lot of time till that happens, so we can visit each other a couple more times. Thank you so much for your answer.

You said you'll study in Berlin. If it's TU or FU they often claim they are paying all students fee but then you end up having to pay a lot nonetheless. Most of the time you don't even get all classes credited that you did in the US. It alwaaaays happens different than what they claim (no additional fees, all classes credited). Look further into the Auslandsbafoeg. They barely give you anything for certain places like the U.S.. Realistically if you are just about to start studying in October, you won't be done within the next 4 years (another 6 months before you start studying, 3 years to get BA, plus another semester for missing credits... cause you know it's going to happen with a semester abroad or failing tests). Just saying...

Probably it wont be the FU, more like the UDK. So how did you do it and how long did it take for you to close the distance?
