Hi! I received the favorable recommendation from DoS on May 24 but I did not receive yet the NOA or the waiver by  UCSIS. Is it normal? Thank you

Mmm... Are you in the US? If you are abroad, mail can be slow. If you are in the US, you might want to call UCSIS and see if you can find out. I've seen one or two cases in which they had misplaced the DOS waiver but it is hard to find your cases too, because you don't have a number. So insist if they want to hang up on you.

If you are abroad you need the UCSIS waiver to go to the consulate. The DOS paper is not enough.

I received the hardcopy of the favorable recommendation by DOS about three weeks ago. Now I am waiting for the final decision by UCSIS who received the favorable recommendation for granting me the waiver.

You should receive a NOA 1 from UCSIS with a number to check the case online. Then, you will receive a green paper which is the waiver.

@Buhr hey dis you already got your waiver from USCIS? They received my case last April 2nd and haven’t heard anything from them. Thanks!

I did. My NOA1 letter took forever to arrive because they sent it to my address in Brazil and the postal service sucks, so I eventually called them to get my case number, they had had my case for like a week. It got approved a few days after I got the case number. They sent the NOA2 to the US address. It took 16 days total from Received to Approved.

Edit: make sure you check the new website because they often won't update the old one. My case still shows as Received on the old system.

What new website? Did you have an H1B application or a spouse petition?

Did you make an inline account with USCIS? I just have my NOA1.

Yes, you have to create an account to check your application status. The signup process is quite lengthy so it's best to do it when you've got some spare time.

I thought I just can check if without creating an account. Did you have a lawyer to file your case?

You can on the old website, on the new one you're required to create an account to check the status.

I did have a lawyer for my fiancé petition but I filed the waiver on my own.

Hi,

They can apply for the H1B if you are in the US and you are AOS from another visa (e.g. F1) to H1B. They cannot apply if you are abroad and doing consular processing.

Will you work for a university or some organization that is not capped?

The salary is based on the company/university and it cannot be lower than it should be. You should never accept a salary that is low because they are trying to take advantage of you!

Yes, I am in USA transitioning from J1 to H1B. I am just chnging the position from Post Doc Scholar to Research Associate in the same university. and my university is cap exempt (non-profit)
