Thanks Annina85, I am sure it will OK for both of us. Anyone else was in the same situation and has tips to share ? Thanks !

I would say keep calling until you get a case number. Then you can submit a case inquiry after about 4 weeks that USCIS has had your case. good luck

Hi,

Could you please share once you receive the DOS favorable recommendation? I have the similar time as yours and still waiting for the favorable recommendation from DOS.

Thank you

Absolutely. Let's keep everyone updated here.

I hope we all can have this recommendation soon. Good luck!

Hey Andyandy seems its seem quite some time(about 4 months since the letter was sent), are you in the US (if so did you change your address and can you get the mail from the old address if you have).  When you call USCIS did you try calling both Vermont and California? I would also get my senator or congressmen involved at this time. Its very possible that your waiver has been approved but you aren't receiving the mail. goodluck

hello fabi_c seems USCIS approved your waiver quickly. Did you get any help from Senators/Congressman, did you expedite it or file for h1b premium processing the same time with just the DOS approval? I'm on a similar timeline as you and wondering when I should start expecting anything. (for me its only been 2 weeks so far so still very early).

Also I realize from others that the USCIS online log in may not be as updated but does calling and inquiring give the most updates info? (will the they see if a case was approved right away or are they also delayed)? Thank you for your help and congrats!

Hi OVO,

Thanks! I did nothing for the USICS to process my case faster. Maybe it was luck. But if you consider that it took 11 weeks for the DOS to send a favorable recomendation, I was not that lucky...

My USICS status is still not updated. So I am not sure if calling would help.

Best of luck to you!

You're welcome. May I ask how long did it take from USCIS sending the 797 to you getting the waiver approved? (which date was on the mailed letter).

Of course the timeline is (following the image chart below that shows only the timeline from the time we sent all the documents to the time the DOS passed on the jurisdiction to USCIS)

Recommendations sent from DOS to USCIS on 06/28/2018

Recommendations received by USCIS on 07/05/2018

I-797 date (by USCIS): 07/20/2018

Hence from the time we sent everything, it took about about 3 months which was pretty quick (lucky me). thanks everyone and good luck !

Hello Journeyfellows:

Below is my current timeline. Only yesterday I received the I-797C Notice of Action letter. It says that the received date was Sep/12/2018 and the notice date was Sep/18/2018.

I just checked the case status on the website and it says: "Case was received at another USCIS office".

I've read on the processing times page that it may take 5 weeks to 6 months for the final decision. Am I reading that right?

Based on your timelines, should I already be expecting the waiver to be on its way?

Sorry if any of the questions sounds too noobish, to be honest I haven't kept track of this process as much as my 2 year residency requirement have already been completed.

Thanks in advance.

Hi

I believe that timeline is for other cases of waiver. not NOS based. Mine took two weeks to receive the approval from USICS. But it varies from person to person.

Best of luck to you!

Hi everyone,

It's been 11 weeks since my no-objection letter has been received by DOS, and still no change of status! Would you folks suggest to call DOS, or what other possibilities do I have?

Thanks a lot for your help!

Mine took 11 weeks to receive the favorable decision. I would advise you to send an email and ask about it.

Best of luck to you!

Hi all,

I am currently in the process of obtaining a K1 Visa, with a possible approval at the end of January - fingers crossed. I am also, however, in the midst of obtaining a J1 waiver based on No Objection. Due to a misunderstanding, I did not notify the Swedish Embassy as it was my belief that DoS would do that. All papers were received in April (as you can see in the picture). In August I realized my mishap and contacted the embassy who in turn sent a 'No Objection Statement' via email to the Waiver Division, as the embassy representative stated she had been instructed to do. That was August 7th. Nothing is showing up on the status website (as you can see), and the email that is provided has not responded to the inquiry I sent two and a half weeks ago. I am at a total loss what to do and feel increasingly stressed not knowing what else to do. Have anyone of you experienced it too? Do you possibly have any recommendations?

This is such a great forum and I wish you the best of luck! 1429763389_Screenshot2018-10-30at16_28_04.thumb.png.8a566fc1eec3a9b970a3fc0ddc5ac927.png

Hi Jack,

I am so sorry to hear that you have wasted such a long time.

If I were you I'd definitely consider emailing or calling your Embassy again and asking for information about your No Objection Letter. Some embassies send it physically via mail and others (like mine, from Brazil) send it via email do the DoS. In any case, be aware that it seems like your NOL has not arrived at the DoS, otherwise they would have updated it on the system already.

When it comes to my personal experience, this just happened: it took a while my documentation had already arrived but I had no updates about my NOL. Then, I sent an inquiry email to DoS and after a few days, they said they had not received it.

In my case, it was just the opposite, my Embassy sent the NOL via email before the additional documentation arrives at DoS, so somehow they did not find it anymore. To make a long story short, I asked them to send it again and one or two weeks later DoS acknowledged they had received my NOL on their system.

I hope you can make up the things soon and fix this situation.

Good luck!!!
