2018 J1 WAIVER TIMELINE

Hi folks,

 

I am from Brazil and I am new here. Since I saw a couple of Brazilians here I was wondering if you guys could give me a hand to solve my issue.

 

I was sponsored by CAPES during my postdoc and had to come back to Brazil for a year to get a "No objection letter" from them. Then, I applied for my J-1 2-year-requirement waiver this week, when I mailed all required documentation to the U.S. Department of State.

 

The real problem came up when I sent via email the documentation (CAPES letter, DS-2019 forms, passport etc.) required by the Brazilian Embassy in Washington to issue my "No objection Statement". Although the U.S. Department of State requires this document to be sent directly from my home country's Embassy in Washington, the Brazilian Embassy replied my email explaining they will not proceed with my requirement because I am no longer living in the USA.

 

I have sent emails and called to a bunch of places, like CAPES, Washington Embassy, US Embassy in Brazil and so forth but all of them said they could not help me.

 

Has anybody gone through such a similar nightmare? Any tips you guys could provide me?

 

Any response is much appreciated.

I just got the favorable recommendation today. Here is my timeline:

Hi, Im from Brazil, and I have never heard about that. It might be worth it to get a lawyer ( I did not use a lawyer for mine). I don't think DoS would accept if it is not sent by the BR Embassy.

 

Good luck! And be patient, it takes forever.

I am not from Brazil but I have been on threads about J1 for a while. I have never heard of something like that and many Brazilians are in Brazil processing the J1 waiver. You should contact the Foreign Affairs Ministry in Brazil, specifically, an office dealing with consulate affairs or an office dealing with these waivers.

 

In my case, the embassy forwarded the waiver information to an office in the Ministry in my home country, they prepare the waiver and forward it to the embassy, the embassy sends it to DOS. Moreover, the embassy cannot make the decision they told you, that is a federal policy, so someone from Brazil can tell them to stop. That is probably someone who has no clue how things work.

Guess what?! Just got good news about my case. After a ton of emails I sent to all sectors of that consulate, they stepped back and reassessed my case assuring me they’re sending my documentation to the DoS.

Hi guys! 

Just a question: Did you file the I612 by yourself? 

I filed the form DS 3035, got the favorable recommendation on May23 by DOS but never received neither the I797 nor the waiver. I've just called the UCSIS but they said me to contact the DOS but DOS no longer has jurisdiction over my case  (their words). I sent more than a couple of mail but they did not answer. What I have to do? 

Please help me.. I gonna cry... I started all of this on February...

I am also from Brazil and never heard of this happening, but happy to hear it was resolved! Best of luck!

(Mine was basically the same as yours but Fapesp instead of Capes and had no problems - I would think you should be fine)

Congrats for getting the favorable recommendation. The DOS received my No Objection from embassy on September 17 and I'm hoping to get the favorable recommendation soon

You need to contact USCIS again and tell them DOS sent the letter to them. They have to request it again. 

 

You have to tell DOS to send the letter to UCSIS again because they have never received it. (Try again.)

 

To be honest, I don't know what else. DOS probably sent it to UCSIS and they lost it. 

 

Last resort would be contacting a congressman/senator of your area (other place of work or family member), and asking them to get DOS to send UCSIS the letter again. They have people that are immigration liaisons and deal with federal bureaucracy.

Congrats! My fee and NOS are both 7 days earlier than yours, but I still have not received Recommendation. I am so so anxious!
