You need a letter from the sponsor (CAPES, CNPQ?) to get the NOS. Engagement/Marrying is not a valid case for it.If you are married to an US citizen you should go to the green card process - you don't need to get any other visa.

I'm on an intern category of the J1 visa so I don't have to request anything to any Brazilian entities like CAPES or CNPQ. I've paid on my own for my J1 visa, and my program isn't either anyhow related to the US or BR Gov. I'm only subject for the 2 year rule because of the skills list.

From what I came across so far, to get any type of residency moving forward I still have to go through the waiver, or go home lol. Even to apply for the green card. I also read that marriage does waive the rule. Has anyone gone through this case?

Oh, please disregard all my comments then. I was engaged for a while during my 2 year window and I had a CAPES scholarship before. That's why it was not a valid reason.

I'd suggest you to email the embassy in NY. They answer within a few days.. If you look at the embassy NOS form there is an area to put information about marriage.

Awesome, thanks, I'll check! That's why I thought marriage was a legit "excuse", I may have seen this form before. I just wanted reassurance if it works as a sole purpose for the US waiver approval, or if by simply being engaged would be a "passing" excuse (since I don't want to get married and be married & away from my future husband for 2 years if anything goes wrong with the process...

Hi folks, just updating my case. I had sent an email to DoS a while ago and they told me a recommendation had been sent to USCIS on Oct 11th. It looked quite suspicious because this date was one day after they got my documents and the case was not updated in the J1 waiver website. Furthermore, I called USCIS one hundred times and nobody could tell me anything about my case. Thus, I sent another email to DoS, which they did not respond so far, but right now I checked my status and realized they sent my favorable recommendation just yesterday.

Quick question for the people who already step into the USCIS stage. Do they send an email to us regarding the receipt number? Or am I supposed to wait and get it via mail? Just wondering because I am in Brazil and it must take forever to arrive here in my mail.

Thanks in advance!

Guys, My case is currently under deliberation at DOS, if someone can tell me when the DOS forwards the case to USCIS how will I get to know my receipt number ? Along with waiver application I submitted two self addressed envelopes one will be used by DOS to share the recommendation and other will be used by USCIS to share the I-797 (I guess). If the USCIS sends the notice of receipt will they use the address indicated o these envelopes ?
