Dear Friends,

First of all, i would like to thank everyone in this thread for sharing your experiences which has been really helpful and positively assuring. 

I would need some advice regarding my case.

My I130 PD is December 2016 CSC office and its neither approved nor transferred to local office, its still "case was received" meanwhile i applied for AOS, EAD, AP back in March 2018 and received EAD/AP card. 

My AOS interview has been scheduled on Nov 26th. Now given the status of my i130,

What could happen in the AOS interview?

Will I be send back without the interview (rescheduled later after i130 approved) due to the status of my i130 or

Would the interview continue but approved later once i130 is approved?

Is all depends on the officer and how much they're informed on the current process. In few occasions they've deferred the decision with approval subject to pending I-130 or in some cases they just don't interview. Is really hard to predict scenarios like that.

Hello again everybody! 

 

Update:

  • my husband became a citizen last week. The ceremony was so emotional, I was crying too. Lol
  • My I 485 status changed to interview cancelled, even though it was never scheduled. I called USCIS and ask to speak to a Tier 2 and I was told that it was an error in their system. So I asked about the possibility of upgrading both I 130 and I 485, now that my husband is a citizen. Well, the supervisor told me it’s pointless to do that, because it won’t count since I already filed I 485. @Bfree3 what are your thoughts on this? Should I go ahead and upgrade both of those petitions regardless? 
  • If anybody can help me with any advice I would be very grateful, or if any of you have been through the same situation and can help please, please, help!

@OanagmzoIn my opinion, it's not pointless if your I-130 is still pending. Because if you upgrade your status it will not be connected to Priority Date and might get approved faster.

@Clotillda first of all, thank you for answering!!! 

thats what i was thinking as well. I’ll just do it. Nothing bad can come out of this right?! I don’t know how to formulate the one for I 485.. should I just go ahead and say what? Bc I’m the applicant, should I say something like “when I filed the petition for family based adj of status my husband was GC. As of nov 6 he became a usc, theresfor I request you to update the petition and continue w processing accordingly” ???

Hello Everyone,


I've a question regarding to processing time for i-485, how does the date for processing time is calculated by USCIS? Do they calculate processing time based on the i-485 priority date or do they calculate based on the date they've received i-485 form application?

 

The information I found is not that clear - https://egov.uscis.gov/processing-times/more-info

 

I found this bit confusing. If they're calculating based on the date they've received the form then I think the wait is way too long for me.

 

Any one knows how this works?

@Oanagmzo I agree. Just file the letter saying your husband is a citizen and to have your petition upgraded. It’s all still connected to your pending i130 so it actually DOES matter and will make a difference. I’m sorry I answered so late.

That’s alright @Bfree3. I took @Clotillda ‘s advice and I sent in the letters Tuesday. Imma have my husband call on Monday or Tuesday and confirm the one for i130 arrived and they got it and I’ll call as well for the i485. Will keep you all posted w any changes that will happen. Hopefully, it will start moving faster.

Hi All,
 
I have AOS interview on Nov 26th. Of all the documents i was asked to bring, there is one that i don't understand, that is
"All documentation establishing your eligibility for Lawful Permanent Resident status"
 
What does it mean? What are the documents that establishes my eligibility for GC?
 
Any help would be appreciated.

You need to follow the second table for applying I485, I765 and i131 if the applicant is living in the US with valid non immigrant visa (AOS process). Or wait for i130 approval and then follow the NVC process (via native country US embassy)

If the applicant is living outside the US, do I still need to follow the second table?
