Also there is a risk as mentioned above that they might not allow Chart B to file when you intend to do so. Either cancel the wedding and file now or accept a longer wait in the whole process. 

 

They did a couple of interviews with people who didn't have their i-130 approved yet.

Do you guys know the 485 current processing date at local office is 130 PD or  485 received date?

Thanks @Clotillda, yes my 485 is at NBC, so 485 will be transferred to local office after 130 approved?

Dear all,

 

I would like to ask you some questions which have been in my mind for several days since I've already started to search on the Internet and some answers are too scary.

Let me explain you my situation real quick. I am a LPR (GC Holder) and my wife legally entered to US with F-1 visa in November 2017, we got married in December 2017 and we filed I-130 in January. Our PD is January 5th, 2018 which is still not current regarding to the Chart B. Her visa has already expired, but she's still maintaining her status as a student and I-20 is valid till April 2019. But we think that we're going to file I-485 (AOS) before April 2019. Now my questions:

 

1) Some people say that if you file for AOS and then extend your I-20 (which is the case for us in April 2019, we need to extend it for maintaining her student status as a backup plan) it seems like a "willfull misrepresentation", which sounded weird to me. You are trying to adjust your status, then extending your I-20, so immigration officer may see it as a "willfull misrepresentation". Any advice(s) in this case? Is there anyone that has heard/seen/known anything about this issue?

2) Together with I-485, most people is also filing for EAD and AP (combo card) which are benefits from AOS. But some people say that if you get your EAD, you don't have to work while studying. Because F1 does not have a dual intent or something. So if you're a student, you're not allowed to work. If you do so, the officer will ask you about this stuff and may not approve your case. Does anyone know something about this situation?

That's what I will do, I'll start my medical on Saturday. Keep in mind that CDC established new requirements for the Medical, specifically the Tuberculosis test, now is something like Quadriferon? (I don't remember exactly the name, but I can send you guys the link.

Hi @Tenreyro, can you show me the where is reference of that instruction? To inform them we done the physical exam?

We are going to get the sealed document after take the Tdap shot. How do you copy the medical document without open it?

I had my medical done about two weeks ago since my interview is coming up soon :S , and i didn't know about the new requirements, but the center where i did the medical knew about them, all i could notice is that they did a blood test instead of skin tuberculosis test. the nurse gave me a Tdap shot on the first visit and said it was mandatory, and there was another vaccine that i preferred not take since i had two option testing if i was immune which costs 99$, or just take the vaccine anyway which costs 120 sth $ i'm not sure. Of course, if you choose to test and they found that you're not immune you'd have to pay for the extra 120 for the vaccine.

@markx about the copy, don't worry, the center hands you your own copy of everything along with the sealed envelope.

July 25, 2018     : Biometric Appt Notice received //  Appointment: August 9th // issue date : July 20th, 2018

August 3, 2018  : Early walk-in for biometrics

August 6, 2018  : Courtesy letter received (I693 was not submitted)

August 7, 2018  : Case is Ready to be Scheduled for an Interview

August 24, 2018: Interview was Scheduled ! Waiting for the letter

August 30, 2018: Interview letter received, Interview scheduled for October 12, 2018 at 2PM

I just learned that i-485 family based processing wait time for Seattle office has moved to 29 months, god knows when my turn will come :( . Looks like a long waiting line for me.

I think you should carry the photocopy of your birth certificate. I am not sure if an affidavit to support the birth certificate will work in your case or not. But if you are able obtain that then carry that as well for your interview. And last you can tell the officer that it was misplaced somewhere but still have a copy of that.

 

But do they really ask for birth certificate in an interview? It will be good to know from others as well.

Hi @Bhumi, sorry about what happened to you. i’m sure you will have your interview again some time. Don’t worry. 

 

We were also very scared of not being to have the interview, and was fully prepared for that to happen. But somehow our IO is very informed about the process, it seems like we are not his first case like this, and we had our interview. We’ve been waiting since then.

 

Well, it is a new process for everyone, so it will take sometime for the standard procedure to sink in. Don’t worry as it does not affect your process.

And center is California service center.

Don't worry @Bhumi, I heard from others' 130 with PD Feb and Mar 2017 are getting approvals, I think you will get your 130 approval very soon
