Hi guys , 

Thank you for creating this forum . I have been here in USA since 2008 and wife is on GC . We filed the I 130 petition on May 7 2018 . 

 

Need some advice on when should i file the AOS . My i 797 receipt notice has priority date blank . As well i think it is current for Dec 2017 . Any suggestion would be hepful .has anyone have their priority date blank ?

Looks very organized and well put together. Did you fill out g1145 for notification and make sure money order was in front ?

Yes, I made sure to put the photos first, then the cashier's check followed by G-1145.

June 28, 2018         : AOS Package Sent

July 02, 2018          : AOS Package delivered at USCIS Chicago Lockbox

July 10, 2018          : Received USCIS e-notification for AOS package reception

July 14, 2018          : Received hardcopies of all 3 NOA1s by mail

July 20, 2018          : Received Biometric Appointment Notice by mail || Appointment date: August 3, 2018

July 25, 2018          : Biometrics done in Lubbock, TX - Early Walk-In successful!

July 31, 2018          : Case is Ready to Be Scheduled for An Interview

August 2, 2018       : I-130 petition approved (received e-notification)

August 6, 2018       : Received I-130 approval notice (NOA2) by mail 

October 25, 2018   : I-765 approved (received e-notification _ New Card Is Being Produced)

October 28, 2018   : Received I-765 & I-131 approval notice by mail

November 1, 2018 : Received EAD Combo Card by mail

July 03, 2019          : An Interview was scheduled

July 11, 2019          : Received Interview Notice by mail

August 8, 2019       : Attended AOS interview and got approved

August 12, 2019     : Received AOS approval notice by mail

August 15, 2019     : Received Green Card by mail

The priority date is left blank on receipts for spouse of USC usually; but with your protected status I don’t know what that would mean for you. I’d schedule an info-pass appointment in your area to be sure.

We all had a priority date to follow. The received date is usually the same date but our priority dates were filled out as well on the receipt. My priority date for the i130 is April 24,2017 when I checked the filing chart which is Chart B  it was currently processing for May 2017. So that is how I knew I could file my AOS along with the others in this forum. In your case you don’t have that priority date filled but because of your status I think it would be best to check with uscis at an infopass( I don’t think calling will help, it seems they outsource those people and they can only answer certain questions and sometimes they give wrong info).

Hey, guys! I created a different topic, but will ask here your opinion as well*)

USPS lost a package with my response for RFE. My mistake is that I didn't make any copies of yellow notices, so they are lost now. Should I wait till USCIS send me back the duplicate or should I right a good cover letter with explanation about what has happened and send the paper work again?

Did you send it with tracking number? Also, why do you think USPS lost your mail, did they tell you that?

 

I don't know for your RFE, but mine specified to send a copy of the yellow paper, not the original. A rule of thumb is, if they didn't ask for the original, send a copy.

 

Lastly, my RFIE took a few days to update for them to let me know it was rrceived, and I heard of people that they never updated it, they only found out by calling. Start by making sure it was lost, and then proceed with USCIS.

AOS with pending I-130 (F2A):

March 2, 2018: AOS Package PD (I-485, EAD, AP)

March 14, 2018: NOA1  / E-Notification // Physical Mail: March 20, 2018

March 17, 2018: Biometric Appt Notice received //  Appointment: April 6th

March 29 RFIE // April 11 USCIS received RFIE response

May 10, 2018: I-130 Approved  :D *But case sent to NVC*

July 11: INFOPASS Appt + Sent Additional Documents

July 20: Case Ready for Interview (Finally!)

August 14: Card being produced //  August 22: Combo Card in hand

8 days from AOS package being delivered to cashiers check being cashed.

12 days from AOS package being delivered to Text and email notifications. 

16 days from AOS package being delivered to getting NOA1 in the mail. 

 

Bear in mind, you had a holiday in between your delivery and processing. This may have caused some delay.

Hello dear friends,

 

Thanks for creating this forum. I am a green card holder since 2016. I have been knowing my wife since 2015. In 2017 she decided to come to US with F1 Student Visa and we wanted to live together. She came here in November 2017, we got married in December 2017, we filed I-130 in January 2018, our PD is 05JAN2018. I have a couple of questions. Our marriage is completely real and bona fide. We are planning to do AOS if Chart B will be current for us.


1) Is it going to be a problem for us at the time of interview? (like why did you come here as a student? why did you get married asap and file I-130?, did you have an immigration intent?)

If yes, how do we have to answer these type of questions to convince them? Yes, she wanted to study for sure, but of course the main goal was to live with me here in US.

 

2) Is 90 day rule applied to I-130 filing or only I-485? If yes, we have not filed I-485 yet, because Chart B is still in December 2017. So we may file in August or in September, whenever we are under cut-off date. 

Please share your opinions, experiences. It'd be very very helpful. And thanks a lot for your contributions.
