I read a post from postman (no pun intended), and he reminded people that mail issued are also responsibility and from the apartment manager. Try to make your apartment number visible, as well as the receiver's last name. And, of course, check that the sender has the apartment written in the address. Also, sometimes people just make mistakes.

March 29 RFIE // April 11 USCIS received RFIE response

May 10, 2018: I-130 Approved  :D *But case sent to NVC*

July 11: INFOPASS Appt + Sent Additional Documents

July 20: Case Ready for Interview (Finally!)

August 14: Card being produced //  August 22: Combo Card in hand

I got our biometrics appointment today as well :D

I-130 F2A PD (still pending): Feb 21 2017, California Service Center

AOS package delivered to Lockbox: Apr 27 2018

AOS package NOA1: May 6 2018 (e-notification) May 11 2018 (physical mail)

Biometrics Appointment: NOA arrived - May 18 2018, appointment - May 31 2018

Case Ready for Interview: June 7 2018

EAD New Card being Produced: August 24 2018 (e-notification) August 30 2018 (physical mail)

i have  a PD of dec 7 2016.. i-130 still pending

 

i am in an impression that you can file 485 and EAD after 130 is approved,,please correct me

Yes you can file485 while i130 is processing only if you are presently in US. I’m sure any additional questions can be answered by reading through this thread. All persons in this thread have applied with a pending i130.

Yes, you can if you are currently in the US. You can't do AOS if you are living outside of the US. I remember us answering this question to you already in different threads.

And as Bfree3 mentioned before, please read throuh this read and timelines/signature of the members who posted here.

Yup, finally i am in the forum where few have applied for a AOS on pending i-130

 

with that said, i went over all the messages in this forum,

 

i see that Tenreyro has applied for an AOS while i-130 pending and while during that process..he got his 130 approved

which works in his favor .

 

couple others have received an interview letter , also called for biometrics (correct me if i am wrong)

Do they call for an interview to get biometrics taken ?

are they calling for an interview to issue an EAD ? ( case chart B has to be current)

is the interview scheduled to process the 485 and get the green card issued? ( in this case chart A has to be current and contingent upon 130 approved)

No it’s not an interview. It’s an appointment where all you do is show your identification and get fingerprinted for background checks. It’s a very short process in most cases.

No they do not call for an interview to issue EAD at least not to my knowledge or what I’ve seen from others here. Once you are approved for the EAD, you receive card in the mail.

Yes,an interview is held and is mandatory moving forward for all 485 petitions. It is NOT contingent on the 130 approval nor the chart it is based on whatever the IO/government decides to allow at such time. There are persons who I have seen that get a 485 approval but the 130 was still pending. The 485 trumps the 130 in that regard.

All of us have already done our biometrics or have been scheduled to go through biometrics. One person has already received a notification of interview for 485 and will update us once they are done and have gotten any info that may help the rest of us.  @helloharsha are you planning to file any time soon ?

the last thing i want to see is a denied 485 because of applying early without 130 being approved.

 I have gone thru so many twists and turns 

 

most of the folks in this forum are in the process.. which is a great initiative..

 I advise you to do additional research then, as I said I’ve seen several approvals of I485 without i130 approval. Good luck!

Hi, I'm glad you came and asked the questions again, read through this thread and you will find how most of us started with Pending I-130.

 

You can apply for AOS as long as USCIS dictate you can. The pending I-130 is irrelevant, as long as your PD is approved for applying for AOS. The USCIS's Policy Manual states that any person in the family category can apply for AOS concurrently, which means with a Pending I-130. The only difference is WHEN the F-1, F-2A, F2B, F3 and F4 can send their AOS packages, that is determined by USCIS monthly, and now they are making it more confusion free than anytime before: https://www.uscis.gov/visabulletin-may-18

No, you have an appointment. You go to a center that provides supporting services to USCIS. They take your fingerprints, a photo, and they are done with you. It takes like 15 minutes, at least in my case no one asked me a thing.

I don't understand your doubt. They process the I-485, yes, and an interview is scheduled, yes, but that is for the final decision usually. After that the green card is issued. 

 

 

As other users said before, you have to be inside the US with a valid status to file both I-485 and any other benefit like EAD and AP. If you are not, and try to come to adjust, you are liable to be bounced back by CBP agents for immigration intention, or seen as misrepresentation later by USCIS.

If you want evidence from a case of any of us, I'm sorry to tell you that you have to keep walking. The use of Chart B to file for AOS has been something implemented less than 3 years ago, that might be seen as a long time, but it is not. It took longer even for people to understand it, and that's why you see some misinformation, and since very little amount of people have file, it is difficult to find cases, and the cases that make the most noise is the people that got into some sort of trouble or that had a bad experience, because bad things are noisier than good ones.

 

If you go back a few pages you'll see of a case I shared of a person that was approved a few years back after a difficult interview (most likely from an agent that hadn't been properly trained by the new regulations). And if you look carefully, you can find F2A filers with approved EAD's. Even lawyers could tell you it is not possible to AOS from F2A, but when the scenery changes that much, people can make the mistake of not being able to not keep an accurate track of the new things.

 

Having said that, remember the process WILL be long, and the most desperate you are, the worst it will be. If you want a sure thing with WHEN will your interview be, and all that, I would recommend for you to follow Consular Processing, if you are a 2017 filer, you are probably past half the total waiting time (But you are not sharing anything in your Timeline, and that lack of information is what later hurts everyone, imagine if none of us shared our AOS as F2A, you wouldn't be having this information). But if you want to be with your loved one, knowing EAD might take more than 5 months, and the interview could had been faster via Consular Processing, then that's your choice, and you are better equipped to handle things.

 

As @Bfree3 said, do the research, you will find bad cases and good cases, this is something you have to decide for yourself, depending how you think you can handle aspects such as waiting without any kind of answer.

Oh, also, of all F2A AOS interview experiences I have seen, to be honest none care about the I-130 being pending, or even if it was approved, I-130 is actually only a thing to mark as checked on the list, it proves that there is a qualifying relationship between the petitioner and the beneficiary. So, with my approved I-130 now all I can say is that USCIS recognizes we are married?

 

Honestly, if USCIS one day decides to come up with a more suitable alternative, with less processing and the same fee, it would be replaced in a heartbeat, and would use the workhours in more productive things.
