My son was born in Canada and my Canadian husband and I live in Canada. My son has a Canadian passport and a Nexus card. We're considering submitting for CRBA and are unsure if we really need the passport since he will always show his Nexus card.

Thanks!

Even as a Nexus card holder, entry into the USA is not guaranteed and visitation is limited.  As a US Citizen entering on a US passport, the answer is different.

YMMV

To clarify, he would be a dual citizen crossing.  I know it says you need to show a USA passport....but we never show passports. Just the nexus card.

Yes, but there may be an situation where he might find himself entering from somewhere other than Canada.  Only you can answer that question

No such thing as a dual citizen crossing/entry..  If the individual is a USC then he/she enters as a USC.

USCs are supposed to enter and exit the US using a US passport.

https://travel.state.gov/content/travel/en/legal/travel-legal-considerations/Advice-about-Possible-Loss-of-US-Nationality-Dual-Nationality/Dual-Nationality.html

" U.S. nationals, including dual nationals, must use a U.S. passport to enter and leave the United States. Dual nationals may also be required by the foreign country to use its passport to enter and leave that country. Use of the foreign passport to travel to or from a country other than the United States is not inconsistent with U.S. law."

Edit: While USCs are permitted to use a Nexus card as well, without having recognized his US citizenship, I don't know if going that route would be consistent with US rules.

This is the part that confuses me. I already had the lecture from the crossing agent, when my son and I crossed using his birth certificate. The guard did warn that if we ever did declare him for citizenship, we'd need to present him as a USA citizen when crossing. But even I do not carry my USA passport, unless I am flying (some airlines request passport instead of nexus). Trying to determine if we should hold off on declaring him, as we fly out to Hawaii in less than a month.

If we don't need the passport, we can just get the CRBA taken care of now....but if we do need it, we figure might as well declare him when we return, as to not cut it close to our trip.

Get both!

You need to enter the child's passport into the NEXUS account so that he is shown as a dual citizen. From then on, you don't need to carry around his passport when crossing. But I would just in case since CBP has been known to refuse those without passports even though they have a NEXUS/EDL card.

Furthermore, using a passport to prove US citizenship is much easier than carrying around a CRBA.
