AOS case received by national benefit center

Hello Vjs

I applied for AOS and sent the package on February 14, 2018 (valentine day) and on last March 7 th I received an sms from that USCIS confirm acceptance of our application and that our case with your Receipt Number starts with MSC.

is that a good thing? I have never seen receipt number starts with such alphabets like in filling for I-129 petition.

how long it took us to receive biometrics? and during this time  am I legal in  the state?

is receiving such notice from USCIS help me to reschedule driving license knowledge test?

please advice me

That's normal. The NBC handles the initial I-485 (and I-131/I-765) before sending the I-485 to the local USCIS field office.

Biometrics can vary, but usually it's a few weeks after the NOA1.

You have authorized stay in the US while your I-485 is pending.

That depends on the state's DMV. Diver licenses (and learner permits) are issued by the state and follow state laws. Some will accept the NOA1 and/or biometrics letter as evidence of lawful presence. Others want to see an EAD or green card. Some will only take the green card.

Biometrics could be two weeks to a couple months.  It is all dependent on how busy your local ASC is and how long the line is in front of you.  They only schedule biometrics two -three weeks out

Depends if your state recognizes the I-797 as a valid document...  Some states do, most do not

hi, thanks for the reply

I am in Connecticut sate, i entered the Us on November 7th 2017. I sat for the knowledge test in January 13, 2018but I failed the knowledge test so I reschedule  on 16 January , that was the only available date. so they refuse me and said lack of INS documents

What date did your I94 expire? Beginning of February?
How come that they let you test on January 13th but then denied you on the January 16th? 
What documents did you bring when you tested the first time?

Thank you again for the reply and for wanting to help me

I did apply for the knowledge test when my I-94 was valid so , as I mentioned I applied in January 30, 2018 (sorry in previous post I mentioned 13 January) and I failed.Rescheduling a new appointment require you to wait for a 15 days and the only available date was in February 15, 2018 that means 11 days after the expiration of my I-94. my I-94 expired on February 4, 2018.

when went to pass the test they start the procedure with me and then later the lady come back and ask me we sorry we cannot proceed with you did not prove legal status in the USA. I said I have marriage certificate and pending Application for AOS . she mislead me and she said you have to show us green card and she did not mention work authorization ,knowing that the later take short time then the former.

I come back home and I wrote a message to DMV explaining them my situation they said a pending AOS is not  a proof of legal presence in the USA.

and they give me a link to how to apply for driving license for undocumented people.

my question now is to whether undocumented driving license is an official document and will not hindrance my AOS or pauses me a problem in the future, and when I get the work authorization can I just re-transfer this undocumented driving license or do I have to reapply again from the beginning to get a valid driving license for documented people.

my wife advised me to not do it , she said , you could be having problem during the interview and if u get a car, insurance rates will be higher up on me.

so this is my story.

I was not missing the acceptable forms of identification , it was ok , what they say is missing is INS meaning document proving legal presence in the USA

4. LEGAL PRESENCE in the UNITED STATES (Non-US born):
Legal status will be verified using Systematic Alien Verification of Eligibility (SAVE) which may take 10 business days or more.
  • US Passport or Passport Card
  • I-94 and US Visa
  • I-551 Stamp in foreign passport
  • Permanent Resident card or Resident Alien card
  • Employment Authorization card
  • Refugee Travel document
  • B1/B2 requires Employment Authorization Card and verified Adjustment of Status Application
  • F1 requires I-20 or Employment Authorization Card
  • J1 requires DS2019
• Non-US Citizens not eligible for a Social Security number must present proof of ineligibility from the Social Security Administration and are not qualified for a verified driver license or ID card.
 
• Only US Citizens and Permanent Residents are eligible for a verified driver license or ID card.

If your I94 was no longer valid then you sadly can not apply for a drivers license :( The lady at DMV was correct.
I have a drivers license here that I applied for while my I94 was valid.
Did you see the link that I posted? You can apply for a license again when you have your EAD. It says on CT DMV website. 
Do not apply for anything where you say that you have no legal status etc. Just wait until you have your EAD

Drivers licenses are issued by the state, so it's up to each state's representatives/voters to set the rules on who s eligible for one.

There is a case to make as to what each state should recognize from other states, but that's likely a Privileges and Immunities Clause (or maybe even Commerce Clause) US Constitutional issue.

Hello I just wanted to know an update on your case? As of sept 11, 2018 we had to do and extra co sponsor for my wife because Hawaii poverty standards are much higher. So we sent it and now our status on USCIS say we have receive your request for evidence and now working on your case. 

I just want to know what your USCIS case status is like. I applied in February for my wife and they sent a letter in March.
