Affidavit of Support Question

Timeline

Me and my fiance are getting ready for our interview, getting the paperwork together. My brother agreed, before we started this whole process, to be a joint sponsor for us. But when I go to look up the paperwork, I see also a mention of the I-864A (Contract Between Sponsor and Household Member). My brother and I live with our grandmother (to care for her, as she has been unwell for years), and it says:

  • You may count the income and assets of members of your household who are related to you by birth, marriage, or adoption. To use their income you must have listed them as dependents on your most recent federal tax return or they must have lived with you for the last 6 months. They must also complete a Form I-864A, Contract Between Sponsor and Household Member . If the relative you are sponsoring meets these criteria you may include the value of their income and assets, but the immigrant does not need to complete Form I-864A unless he or she has accompanying family members.

My brother is related to me by blood (same father and mother) and we have lived in the same house for the last 3-4 years.

 

Does anyone know if there is any difference or which would be better in our case? I know I probably don't make enough to qualify as a sponsor by myself.

 

Side question: The Affidavit of Support asks "I [  ] intend [  ] do not intend to make specific contributions to the support of the person(s) named in Part 2." Like, he will be my husband, I do not intend to give him X amount of money for food, say, but he will be living with me, my money is his money, so I will be supporting him completely. So what is the answer to this? I don't intend to make specific contributions but I 110% plan to support him, obviously. Do I mark intend or do not intend then just explain? I don't know what is right for this.

Feb 19 - Sent Packet 3 (hoping to hurry the process along)
Feb 22 - Embassy e-mailed us and told us to schedule our interview (interview scheduled!)

Mar 6 - Actually received Packet 3 information in the mail (glad a friend told us to just go ahead and send it, that took so long)
April 4 - Interview (we were accepted!) {155 days from NOA2}
April 6 - Im
migration packet for border patrol and Passport arrived at his house (we paid for premium shipping)
April 26 - He entered the US on his K1 Visa

April 27 - We got married!! <3 <3 <3

Can't answer the first part because I have no idea about that. But for the second question, you check ”intend" and then go to Part 7 Additional Information and state "N/A. Filed I-129F for fiance's K-1 visa application."

ROC filed on December 1, 2020, assigned to SRC, approved within 106 days on February 18, 2021.

You have to be at 125% of the poverty level to qualify. If you list your grandmother as a dependent you need to check how much that would be for a household of 2. The same goes for your brother. It counts if she is listed as a dependent on their tax return. If you list more people than just your grandmother you need to factor that. If you don’t then it’s just 1 person. Check the numbers on USCIS website. A cosponsor can be any USC or LPR. They don’t have to be related to you. I864 is not until adjustment of status. You are submitting i134 at the interview.

That part about intend to support is not about your husband. Read the form carefully. That part is about whoever you are listing as a dependent on your tax returns. If you don’t have anyone you leave that blank. If you do you say how much support you give them. If they are fully dependent on you or not.

I do not have any dependents (my grandmother has money), we just care for her as she is in poor health. My brother also supports himself, so I am only financially responsible for myself. And my brother has a very good job, he is the best person for a cosponsor that I know. So I just have him fill out a i134 as well?

 

Also I could be wrong, but Part 3 is where I would list any dependents I have. Part two is listed as "Information About the Beneficiary", where I put Chris' information, so I would assume it is talking about my intent to support the immigrant.
