K-1 Visa - Which Passport to use?

Hi everyone,

 

It's my first time posting on this website and I really do hope that some of you may have or have encountered similar issues as mine. Me and my fiance have filed K-1 on Nov 9th, 2017 and still waiting for NOA2 (no news as of today), I have a question regarding the passport.

 

I recently obtained my Hong Kong passport around September, 2017. I have US B1/2 visa stick on my Chinese passport, and when I am filing for K-1 I only provided my Chinese passport copies as I thought it's relevant and all the visa histories are on it. But my concern is when I will get my K-1 visa, should I provide and put it on my Chinese passport or my Hong Kong passport? I plan to give up my Chinese passport next year in 2019 and I am not sure if this will be an issue for applying for the green card? Does it have to be consistent? Let's say if I use my Chinese passport for K-1 and green card and next year I give up my Chinese passport and only use Hong Kong passport, will the green card still be valid? Sorry but just want to see if this will be an issue..thank you!

I think the easiest way to solve this problem would be to only give up your Chinese passport after you get a green card. Is there an urgent reason why you want to get rid of your Chinese passport? Because if not, waiting an extra year until after you AOS and get your green card would solve your problems. Also, since you filed in November 2017, even under the worst scenario under current timelines you would most likely already be in the U.S. adjusting status by January 2019. Really, you would only be waiting a few extra months to get that green card, and then you'll be free to ditch your Chinese passport

08/21/2019: Green Card arrived in mail

Thank you for your reply Misken, China doesn't allow two passports at one time so I decide to keep my Hong Kong passport and my permit to enter China will expire in 2019, so that's also a reason why I need to give up my China passport in order to apply for a permit relating to HK passport to enter China next year. Yes, I will be getting my K-1, very likely in June 2018 and will apply for green card and get it by the end of this year.

 

Hope it doesn't confuse you, so basically my question is will U.S. green card be valid even if I give up my China passport next year? does it stick to one passport or it doesn't matter which passport I used when applying for green card? Like will there be passport number written on the green card or something. Or if I changed the passport in relating to when applying for the green card, will it be a problem..? Thank you!

Your GC won't have your passport number on it however it might be wise to keep a copy or record of it somewhere. If you ever need a 551 stamp it will be in your passport but I'm not too familiar with it as I never obtained one. 

 

Did you have your interview yet? If not maybe you can leave your other passport at the embassy for them to put the sticker in it since you'll be keeping that one.
