My husband got to the States 1 yr ago. My step son will be 21 in July of this year. Is it too late to file an I130 for him? He's 4 months from being 21.

Please advise, he lives in Jamaica

how old was he when you married your husband?

 

if it was under 17, you can file for him, if not, then yes, it's late

 

his dad can file for him but he will be approved as child over 21 of a resident and will have to wait several years

Thank you very much for the information.  Yes he was already 19 when we got married.
