Hi guys,

does anyone have a sample of affidavit from friends\relatives? I have most of my documents ready and applying to vawa-based AOS soon, and since I don't have any police reports and such, I want to submit as much of other evidence as possible.

If you don;t have a police report then you should attend therapy 5/7 sessions and have a psychological evaluation done.

The affiants should put they name, date and place of birth, address,  if they are U.S cCitizen or GC holder, when and how they met you, . What do they know about your courtship,if they attended the wedding or not .If they met your husband and when, where, if the person visited your house, or had dinner out together with you and your husband etc...

Yes you need to include a copy of passapport, birth certificate and  the I-360  receipt.

You don;t have ground to appeal. File a new AOS.

Thanks a lot for your response. Should I include form i864w or i912 when filing the new AOS. And should I include the denied notice?

You have to  wait long time, 18 months to have an interview schedulled. They are  adjudicating the cases filed in November 2016.

Thanks Sandra. So the transfer date Jan 2018 to NBC is considered for adjudicating rather than the initial receipt date of November 2016.

Hello everyone.

I applied for VAWA in 2016 and was denied a year later in January 2017. I did not receive any deportation letter and i'm not in deportation proceeding due to my current visa status.

At the time, I hired an inefficient attorney that had his workers quitting on him reason, stuff getting mixed up and even when I was denied, I wasn't notified of the denial until after the 30 days passed so I didn't have enough time to gather additional documents to appeal the denial. Some documents were not included in my package like tax transcripts, enough photos, etc. He didn't even provide feedback on my declaration.

I didn't re-apply immediately because I was pretty much damaged and depressed as a person the whole time and was also seeing a psychotherapist. Can I re-apply a second time though its been over 2 years we've been together or last saw each other? Has anyone reapplied with more evidence after a denial and got their VAWA approved?

You can refile if  the marriage was terminated within 2 years prior to the date of filing.

Congratulations on the approval  😊 It's understandable that you felt discouraged, but I think Sandra is very helpful perhaps her opinion is based on most the previous cases she has come across, aside from the typical protocol and procedure there is also the "human factor" we can't predict with absolute accuracy whether an officer who studies a case/file will sense credibility or be  moved by the applicant's statement! I'm glad you made it and wish you a speedy & easy AOS approval. 🎆🎇

Congrats! Miss Sandra is very wise, and has helped me too. She’s human and ever so often, her advice might not turn out to be what you want to hear. We appreciate her, and value her. She helps us for free. Your bad experience is yours, but we have our experiences with her too. You said you can get help from the forum, and not to listen too much to what people on here say - that is a very contradictory statement.

I am super excited for you. Your experience seems to be something someone can use for their case in the future. You triumphed! Welcome to the “Home Stretch Club”. God bless you, and I hope your interview is scheduled soon and goes well.

I mentioned that your evaluation had zero information stating about abuse and USCIS would deny your case. When someone sends me the just the psychological evaluation I am giving my opinion about the evaluation that I received. You sent me your evaluation and I stand by what I said. I did not see your whole file because you did not email me, I did not read all affidavits that you submitted proving abuse because you did not email e either. MY OPINION WAS TAKING INTO CONSIDERATION THE EVALUATION THAT YOU EMAILED ME.

Vawa approval is not just about the evaluation, it's about all proof submitted along with I-360.But of course if the person will submit just an awful evaluation the case for sure will be denied. Again , I gave you my opinion considering what you emailed me!!! IIf anyone here wants to hear my opinion about the chances of approval then submit all proof, do not send me one single proof and come here to bash me. I am here helping survivors of domestic violence for 11 years I handled over 6.000 VAWA cases and NEVER EVER HAD A SINGLE ONE DENIED ad 40% of them were/are members of visa journey.

Thank you Sandranj for beeing here for us.

God will continue to bless you
