Your case was received. Stop worrying, you will drive yourself crazy. Prima facie has nothing to do with whether your case was received or not.

Hi ! Every one !

   Good evening! 

    I have questions if anyone of you can answer me . I am worrying a lot now. 

 My attorney said she sent my VAWA case on 15 th June .but I did not got any receipt of it until now . I asked her about tracking number so I can check if it was delivered. She only emailed me about my case was delivered on 9 th July . 

    I asked her about copies she sent to Immigration office . She gave me the copies but there missed a lots of documents that I gave her .i asked her why she did not sent other documents together? Do these documents would not help my case ? She said she sent all documents but only gave me a part of them . I read the cover letter that she wrote but there really does not included my other police report/ medical records and inquiry pics  some letters from my friends to support my case etc.

  is these possible the attorney does not give all of the copies that she sent to Immigration office? 

 

    My other questions are 

   How long does it take to get receipt after filed VAWA ?  

   Does it took almost a month to got delivered ? 

   Why I am worrying my attorney does not sent my case out so bad ? Because I gave her all my documents to file VAWA over 4 months she did nothing . I keep asked her when she can file it so she keep told me “next Friday . “ for over a month  !

  Finally she said sent my case out but I get none receipt notice until now . It has been over a month already  . (From 15 June /18 to now )

   I heard about new policy of effective to immigrants on 28 th June. I am worrying about if she did not sent my case out yet it will really mess up my life . 

    What I can do now ? I can’t sleep every night !

If you don’t trust her, take her off your case. Between my receipt date and notice date were 6 weeks. Around 4 weeks from receipt is normal.

4, My 9 pages affidavit declaration of the abuse

5, Four letters from witnesses in US , she slapped me in their presence on different occasion , and  letter from my younger brother in United Arab emirate,he explained what i told him about the abuse from my wife

6,  Three police report paper " i went to report after we separated"

7, Her Gun picture, My wife picture with marijuana smoke because she  use to lock me inside when she smoke and marijuana smoke make me dizzy, after smoking she always ask  for sex by force. 

8, Marriage Certificate, Wedding pictures, Both Birth Certificate, House Lease and school kids pick up paper shows our names.

9, Her pictures with another man calling him husband and the letter her former boyfriend wrote to her  "when i was with her, i asked her about the pictures and letter, she turns everything to violence and call me names because she cheated on me"

10, Copy of fake check she deposited into our joint bank account before the account was closed "  when i asked her about the check deposited with her mobile number she slapped me and  told me that i am weakling. DO I HAVE ENOUGH EVIDENCE FOR VAWA  OR WHAT DOCUMENTS DO I NEED MORE ?

1. If you don’t have an attorney, you can send Sandra your psychological evaluation so she can tell you if it’s good or not.

 

3. Only submitting letter for good moral character is not enough. You will be guaranteed to get an RFE. You need to submit police clearance from all places you lived in for the last 3 years (since July 2015). 

 

7. Only pictures of her without you in them will not be looked at because they could have been taken anywhere. Pictures submitted to prove abuse either have to show physical abuse marks on your body or her in the picture forcing you to do something or harming you.

 

9. This is unnecessary. Cheating has nothing to do with VAWA.

 

10. Explain well in your affidavit how she financially abused you. Only submitting the image of the fake check will not help.

 

in general, make sure you explain the instances of abuse in chronological order. Don’t mention her cheating on you unless you directly tie it to an abusive moment. Cheating is considered an unpleasant marriage but not extreme cruelty. Explain well how the physical abuse happened. Make sure the dates you mention in your affidavit are the same as witness statements and police reports (for example: if your affidavit says she hit you in January 2017, don’t have a witness statement that says December and the police report says February). This is very important.

180 days today that I went to my interview and no answer yet!! 

At the day, the IO said it was approved, but after, I did an infopass and they said it is pending adjudication.

Hello what country are you from? I guess that you can explain to them that the error with the "birthay date" happened because in your country you write the day first and then the month, in my country Argentina we do it that way, is very easy to be confuse when all your life you wrote it with the day at the begining.

5/12/94 or 12/5/94 is a change in numbers order only easy to explain to them if you can proof that were you come from people write it that way for example you can ask them to see your birth certificate for guidance.

Of course your case is considered received by USCIS.

I sent my EAD renewal category C09 to VSC last week. Post office reciept shows it has been received but online update has not been changed at all. When should I expect an online update? Or even biometric appointment?

Please advise.

It is normal for receipt notices to take around 4 weeks. Can be faster, can be a little slower. Just be patient. If your last biometrics are less than 15 months ago, they will most likely use your old biometrics.

Cheating is not something that USCIS will consider for a VAWA case.

 

You need a police clearance from all places that you lived in the past 3 years.

 

Make sure each affiant put his/her full printed name, date of birth, place of birth, current address and phone number, and the person should swear that the facts are true and accurate. The person should mention in the affidavit how he/she acquired knowledge of the abuse and/or bonafide marriage, if he/she attended the wedding or not, if not why not, if the person met your spouse when and where.

 

Submit pictures with your spouse and her family and friends(write in the back of each picture who are in the pictures, where and when were taken)
