Guys did anyone ever get an update like this. I haven’t sent any correspondence to them since I submitted my application, so just wondering what that means or the correspondence their talking about?

USCIS is messy when it comes to updating online statuses. Everytime someone looks at your case, they have to put in an update. It could just be a lazy officer who put in the wrong status. Don’t worry so much about online updates. USCIS is not good at them. Just focus on the actual notices you get in the mail.

They are typically pretty good about replying within 60 days. What day are you on?

You can write a letter to inquire or make an InfoPass appointment or contact your Congressman or th Ombudsman if it takes more than 60 days.

I got police clearance from 4 different countries across 3 continents. Each procedure was different but I emailed with the responsible office each time when I had questions and it worked every time. I would just contact them and explain your situation. There is definitely a way to get police clearance. One time I had to get ink fingerprints taken here and sent them to the other country’s police station. Everything is possible.

I actually just re read my RFE and it said that I already send my record but something else showed with a different birth date and a different name now im so confused

One of the court records has a wrong birth date. You need to get that fixed. I would consult an attorney for that. It looks like your I-360 form shows your birth date to be 12/5/94 and the court system has 05/12/94 in their records. You need to submit clearance for all aliases you have ever used.

Also it looks like you need to submit police clearance from the country you lived in prior to coming to the US in 2014.

This updated guide goes into effect on September 11, 2018 and applies to all requests and requests, except for Deferred Action for Childhood Arrivals (DACA) awards received after that date. "
This are my questions:

     1. Will cases received before September 11 be exempt from that rule? I want to ask,

     2. The cases that were submitted to USCIS before September 11 (with or without Prima Facie) but the time of review of the case was after September 11 and during the review they verified that they lacked any evidence or inconsistency, before denying the Will they request an RFE or will they simply deny the case?

Please help me with your comments, thank you ...

Just for my knowledge, I filed in 28 June 2017 and I entered USA on 10 June 2014, do I need a police clearance from my country too? Thanks

You need police clearance from all places you lived in (that you stated on your I-360) 3 years prior to filing.

if you filed 28 June 2017, you need clearance from each place you lived from 28 June 2014. Since you were in the US that entire time, you need police clearance from all states you lived in since then.

In case the psychological evaluation sent to USCIS is not so solid, before denying the case, would USCIS request more evidence of abuse? In the event that USCIS requests more evidence of abuse, can a second psychological evaluation be sent after having attended more than 12 therapeutic sections with another therapist?

Yes you can submit a new psychological evaluation in case USCIS issues an RFE  requesting evidence of the abuse. If you receive an RFE to prove abuse I suggest that you write down a better affidavit mentioning all details about the abuse suffered.

The new USCIS policy, regarding RFE  applies to cases filed after September 11, 2018

Your attorney can file a motion to reopen. The USCIS usually adjudicates within 90 days.

Thanks iwillsurvive for your answer, please help me clarify my specific situation better.

My file was sent in May and one month later (June) USCIS sent me an application for RFE (good moral character), I will send the requested evidence approximately on August 20, which means that I will not have a PREMIUM FACIE before September 11, since USCIS takes approximately two (2) months to send the PRIMA FACIE after receiving the response to the requested RFE.

image.png.4b427de95e21fc6ff711143a1cf645b9.png
I ask:
1. Does USCIS consider a file as "RECEIVED" after it has been deposited with USCIS?
2. Does USCIS consider a file as "RECEIVED" even if the file has not been granted the Prima Facie?
3. Would the law apply to cases received after September 11 or to cases that, starting September 11, do not have Prima Facie?
Please, I beg all of you to help me clarify this ...
Thank you….

1- NO

2- YES

3- It applies to cases filed after September 11th, 2018.

The USCIS memo is regarding RFE and NOID.

You did not get a fingerprint background check, it reads as if u went to the court website did a name search and printed it.  Since ur immigration file has different names and birthdate than what u sent in, they are rejecting your information and now are giving u a chance to submit fingerprint background checks.

It became clear to me that the new rule will affect the cases received by USCIS after September 11. But now I am confused if my case is considered "received by USCIS" or is not considered received by Not having Prima Facie.
My Vawa file was sent to USCIS in May, in June I was asked for an RFE, I am going to respond to that RFE within 30 days. I do not have Prima Facie.
I ask:
1. My case is considered filed (RECEIVED) by USCIS?

Please, Sandra help me understand, thank you very much !!
