I have only submitted my I360, no PF only GMC RFE.

Hey everyone.  I'm new to this forum.  

I'm gathering my information and documents to file Vawa. This forum has HELPED ME SO MUCH. I've been reading many post and have an idea of what I need to file.

 

I do have a question,  I entered the country without inspection .  I basically came here illegally. Will that effect  my case ? Do i have to file a certain petition algond with the I 360 because of it?

No, VAWA is very forgiving because USCIS knows that a lot of time this is caused because of the abuse because many abusers use immigration as a way to control their victim spouses.

@MariFD Not with Vawa, but when you do your i-485 Adjustment of Status, you might need to submit a waiver for it.  I highly suggest you do your AOS with an attorney who has experience with waivers.

I read that if you vawa gets approved or before and you submit the i-485 you have to submit the I-601, Application for Waiver of Grounds of Inadmissibility. They have special instructions for vawa candidates in the uscis instructions. Like someone said before, its better if you get a lawyer for that.

@Kersac The Prima Facie letter is good news m it's  to simply let you know "you have a case that will be reviewed and in the meantime use this  letter for public benefits if needed" 

 

RFEs may still come up, some people receive before getting approved. Hopefully you will not get one.

May 2016 retained an attorney and started to prepare my VAWA petition. 

11/08/2016 mailed my packet

11/28/2016 USCIS rejected my packet (expired forms) :(((  

11/29/2016 Mailed my packet again Via ExpressMail (I-360, I-485, I-864w, I-765, I-912, G-325A) with previous rejection notice on top & a request to expedite EAD

12/14/2016 Date on the NOA  

12/31/2016 Attorney emailed my Prima Facie (Notice date 12/19/2018)   (180 days)

01/14/2017 Mailed my husband’s birth certificate with the blue receipt that came with my Prima Facie

01/17/2018 I-360 online Update (correspondence received)

12/25/2016 Notice for Biometrics

01/12/2017 Biometrics completed

01/31/2017 EAD update (Ordered my new card)

02/04/2017 My first EAD delivered.

02/06/2017 Picked my EAD & applied for SSN

Vawa will forgive, but she will be denied I-485.  You still have to have legal presence.  That is different than an overstay of a visa.  This is where a lawyer is needed.

Hello everybody! If somebody already  had an interview of I-485 (based on VAwA) how long after was your green card approved? Please share your experiences! Thanks

They do not send the EAD category  C31 before VAWA approval, many people had the  I-360 approved and they did not know about the approval until the  AOS interview date.

Yes you can file I-360.

I have received a EAD C31 two weeks ago and so far no approval notice. 

There was a update on my I360 about a card being produced.  Week later the C31 arrived!
