It might mean that even if you departure the country with Advance Parole when returning to US you can’t be found to be inadmissible to enter to US. Sandra always advise not to leave the country while you case is pending. There is always a risk and is up to the officer to allow you back.

What if the vawa is approved and differed action was granted? Has anyone here used AP? If so plz share your actual experiences if you don't mind. Thx

May 2016 retained an attorney and started to prepare my VAWA petition. 

11/08/2016 mailed my packet

11/28/2016 USCIS rejected my packet (expired forms) :(((  

11/29/2016 Mailed my packet again Via ExpressMail (I-360, I-485, I-864w, I-765, I-912, G-325A) with previous rejection notice on top & a request to expedite EAD

12/14/2016 Date on the NOA  

12/31/2016 Attorney emailed my Prima Facie (Notice date 12/19/2018)   (180 days)

01/14/2017 Mailed my husband’s birth certificate with the blue receipt that came with my Prima Facie

01/17/2018 I-360 online Update (correspondence received)

12/25/2016 Notice for Biometrics

01/12/2017 Biometrics completed

01/31/2017 EAD update (Ordered my new card)

02/04/2017 My first EAD delivered.

02/06/2017 Picked my EAD & applied for SSN

Thanks for the advice, When i saw the letter and pictures and i asked her she turn it to violence and calling me names .  We went to music concert with friends and we had  argument inside my friend car ,she slapped me in the present of them. We went to oil change shop and we met uncle there,we had misunderstanding and she slapped me  in his present. she always ask for sex after smoking marijuana or when i am back from work and tired,  etc

With all of the above , she threaten me with deportation and gun.

There is a difference between abuse and unpleasant marriage. To file VAWA based on psychological abuse, the person needs to prove EXTREME CRUELTY.

 

1- Depositing a fake check with her name into the joint account is not considered extreme cruelty.

2-  Going to your Country and meeting another man is not considered extreme cruelty, she is a cheater that is it.

3- Her  ex-boyfriend writing a letter to your wife is not considered extreme cruelty.

 

If she physically abused you then you should submit a police report or a shelter letter or a valid restraining order.

You are welcome! That is actually considered physical abuse and mental abuse. You must write a good affidavit, you can search in the internet just put how to write a personal affidavit for vawa. :)Write as much as you can in how she mistreated you and slapped you infront of your families and friends. You can also attend a psychologist/psychiatrist  and see if he see you have signs of pstd or anxiety and write you an affidavit about it. If you have police reports, have a copy of those as evidence of she doing harm to you. Make all the people who saw she being physically abusive with you, write an affidavit explaining what they saw and addressing she was mean towards you. What you described about sounds like she was bullying you which can count towards mental abuse and also slapping you, which counts as physical violence. Also all affidavits if you can, have them notarized. Wish you good luck!

Guys anxiety taking over me !! Its been a looooonnnnggg journey when I got a copy of my vawa approval it said it was approved on may the 25th 2018 does anyone know how long it takes for VSC to send it to my local office????

VSC will usually send your case to the national benefits center within a few weeks. Since USCIS is pretty unreliable when it comes to online updates, you may or may not get a notification. They do typically send you a courtesy notice of transfer though. The NBC usually takes 30-45 days according to Sandra (I am on day 27 after receiving my transfer update). Then the NBC will transfer your case to your local office and the waiting starts all over again.

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Congratulations to al the approvals!!! I am a January 2017 filer so I hope I hear something soon. They received my GMC RFE on 5/31/2018. Keeping my fingers crossed and praying a lot. Anxiety hits me that it could be denied but I'm trying to stay positive.

 

 

I have only submitted my I360, no PF only GMC RFE.
