Hello Sandra/Everyone, i am new here and i need help to file my vawa. My wife went to divorce after abusing me physically, financially and verbally , final divorce decree is next week. Can i still file VAWA after final divorce decree ? please i help. Thanks

If she wrote bull on the divorce papers then don't sign for it cuz it will be in the record.

Could u tell what she wrote on the divorce i mean divorce base on what? so we can gather idea to solve that problem

Please, i want to know if i have strong case to file for VAWA :

{1} My wife deposited fake check  with her name into our joint account and she  got the money without telling me. when we did not pay back ,bank close our  joint account .

{2} My wife went to Ghana to meet my parent and i  paid for everything, on getting there she went  to stay with another man and calling the man her husband on social medial with pictures.

{3} My wife ex-boyfriend wrote a letter to her that he got my wife letter with pictures. She use to call me names in the present of friends, damage my phone twice for calling my parent and speaking Mande/Soninke my native language, Threatening me with adjustment of status, etc    """ I have evidences for all """""

Anytime i asked her about it, she will turn it violence and attack me. CAN I FILE FOR VAWA PLEASE ?

My did samething to me put fake check on our Account it was closed but locky i am she couldn't withdraw money.

U can file base on psycological and emotional

I read that cheating does not count as abuse, however, since she was threating you with deportation, calling you names that can count as mental abuse, its harder to prove that one, but its not impossible. You can do a psychological evaluation, and also make your friends or family write affidavits whatever they knew of the abuse such as them hearing she called you names. Plus writing a good affidavit of how bad she treated you, and how this make you feel, can help your vawa case a lot.  Good luck. 👍🏼

Gd morning everyone.. I woke up this morning to an email that there is action taken on my case. After 19mths of waiting they finally sent card is being produced... Does this mean case approved? I just want to make sure either way I am really happy..

Cheating is not grounds for VAWA, so don’t mention her doing that as it will only seem vindictive on your side if you do. 

You will need a professional psychological evaluation as proof that you were mentally abused. The psychiatrist/psychologist

needs to diagnose anxiery/depression/PTSD etc. YOu need to attend at least 5-7 therapy sessions. 

If she is physically attacking you, you need a police report/restraining order/hospital records of your injuries. 

write your own affidavit very well and in-depth. have family and friends of the two of you write witness statements about the abuse they saw. have them notarize their statements. THE more statements the better. 

you will also need to submit proof of bonafide marriage, that you lived together and that you are a person of good moral character.

WHich state are you in? DIVorce forms and laws vary per state. I can only speak for CA but courts mosty have a self help center that will supply you with the forms and then they have paralegals that will look over your forms before you submit them if you are not represented by an attorney. I did it all by myself and it was not that difficult. LEt me know if you have questions.
