I have not!!! I previously went to my congressperson it was a complete waste of time.

May 2016 retained an attorney and started to prepare my VAWA petition.

Senator Marisol Alcantara...did congressman too they did call though but nothing changed at all ...

Keep on trying the Senators guys. If we don’t push them and give up trying, why should they push for us? It is our future at stake, not theirs. 

 

I also send a cover letter with every correspondence. I end the letter with how much I’m looking forward to their kind and favorable response. 

 

When I got the RFE for background check, I wrote another personal affidavit, and put in good stories from my past and even current events. Like for example, I sent evidence of my charitable donations, I printed Customer comments from work, I wrote about when I talked a man out of committing suicide, and that I’ve paid taxes each year. I let them know that I wish to contribute positively to the American society and just list good things about myself. I also reminded them of the hardship to my family and myself should my petition be denied.

He must attend the interview in his home Country and because he overstayed he must file a  waiver before he leaves the U.S. He is not elegible to attend the interview in the U.S. The waiver will BE adjudicated within 6/8 months and once approved he can go to attend the interview in his home Country , he will be able to reenter in the U.S without problem, but as said he should not leave the U.S before his waiver is approved .Read bellow what USCIS states about it.

 

Foreign nationals who are not eligible to adjust their status in the United States must travel abroad and obtain an immigrant visa. Individuals who have accrued more than 180 days of unlawful presence while in the United States must obtain a waiver of inadmissibility to overcome the unlawful presence bars under section 212(a)(9)(B) of the Immigration and Nationality Act before they can return. Typically, these foreign nationals cannot apply for a waiver until after they have appeared for their immigrant visa interview abroad, and a Department of State (DOS) consular officer has determined that they are inadmissible to the United States.

The provisional unlawful presence waiver process allows those individuals who are statutorily eligible for an immigrant visa (immediate relatives, family-sponsored or employment-based immigrants as well as Diversity Visa selectees);  who only need a waiver of inadmissibility for unlawful presence to apply for that waiver in the United States before they depart for their immigrant visa interview.

This new process was developed to shorten the time that U.S. citizens and lawful permanent resident family members are separated from their relatives while those relatives are obtaining immigrant visas to become lawful permanent residents of the United States.

Hi Guys, got an update today (Sunday? 🙀), saying my case was transferred to another office. I’m so happy. I hope my interview letter comes soon...(or better yet, no interview at all - straight to Green Card approval 🙏🏿). 

 

I just realised that this update might be for the transfer notice, dated 3/14 that I received. It said my case was transferred to NBC. The online update I received today  said “this office now has jurisdiction..” I’m confused if it’s at the NBC or my local office. I suppose the letter will let me know (it also said a letter will come after). 

 

I’ll keep you updated.
