Check the forms that you submitted. You have to use the most current version of the form, when you go to the forms website download it directly from there. They have updated a lot of forms lately so if you use an old version they will return your application.

You are right! I got the form from USCIS office they should at least have an updated form. Thank you. And do I need to pay the fees now since I wasn’t able to pay it the first time but now I can afford? 

 

And the most recent I-765 form on the website expires on 02/2018. They don’t have a recent one. Do you know where I can get the  recent one? Thank you

If you have police report that also help, also your personal affidavit explaining how, when, where abuse happened and how is it affecting your life (even if you wrote one before it is okay to write again but with more details,try to be very specific). You should also mention if he threatens you with Immgration or deportation because this considered to be abuse too. What kind of proof did you send in your original packet?

    But my attorney is not good at immigration law . She does not agrees to send my I-360 and I -485, I -765 , also she said I can not  file I-485, I -765 for my children at the time . My children are living with me at USA now and they are very young.

    She said I only can file I -360 and I-765 choose c31 for EAD

   At that time my children and my AOS were pending . 

   

She just wasted my 4months time and messed up my case . I got notice that USCIS denied my AOS I -485s that my husband did sponsored for my children and me , also revoked my EAD card . Deined my I-130s they my husband applied for me and my children. 

    I faird my attorney because I feel like she wasted  my time and messed up my case . I gave her my documents in Feb but even now she does not has good plan how to organize my case and just want to send I-360 for myself . But never send my case out only said I will be done it next week ! 

    I forward the notices from USCIS I got today to her and she said that is good . So she can purpose to file my VAWA . 

    

   I am looking for other attorney but since I am in the hospital give my baby birth , I don’t have time to find good one in short time . So I am thinking to send my case by my self . 

    Anyone of you please help me , what I can do ?

   Can I file I-485,i765, I 864w for my children same time with my VAWA together? My children are living with me at USA and my husband is a US citizen . 

   Can I file I-360, I-485,I 865w ,  I 765 choose c09 for my self ? 

    Is USCIS putting my children and my name on the removal list since my husband withdrawal his sponsor today ? 

    I do ask recommendation for a good attorney who is good at VAWA case and can take care of my case sooner . It would be good if attorney is in  MN or closer to MN . 

    I am totally lost ! Help me please !

My ex withdrew my I-130 on aug-3-2017, my requests my attorney filling all I-485 and I-360, and I-765,he rejects me .and then I keep request ,because before I submit all documents by myself for apply  marry greens card .

If you filed I-485 concurrently, your I-485 will be transferred to the National Benefits Center and after they check it for completion, they transfer it to your local office who will send you an invite to an interview. Processing times at local offices are pretty long right now unfortunately. You can check how long your local office takes on the USCIS website. Count from your VAWA approval date onwards.

I have a question guys, I filed for vawa Nov-2017. I received a RFE in January for good moral character. I sent the police/Fbi clearance in March and USCIS received the response on March 12. It's Been around 3 months but I have not received prima facie. Has this happened to anyone else? Is it possible not to receive one?

My case was similar to yours!!I applied January 2017. February 2017 RFE for Good moral character.I sent FBI clearance April 2017 then a week later I received Prima Facie! Good luck

Dont warry ,, some get prema facie some no.. Isaw someone posted her vawa being approved but she never had prema facie...

Hello Friends,
Can someone explain to me why FORM I-797C, which is the document that USCIS sends when sending an I-360, says that Form I797C "is not evidence that your case is still pending"?
What is the document sent by USCIS considering that one has a Vawa case pending in USCIS ?, since I understand that not all people receive the PRIMA FACIE.
I thought that when USCIS received the vawa file automatically one had a pending case in USCIS.
Someone to clarify this please!

Hey guys i was wondering if any of you ever had to find a job while your working permit expired and you have this 6 months notice while waiting for the new one. My question is how easy or difficult has it been?

I had the same rfe and I just sent affidivits from friends and family my vawa was just approved yesterday

@Behuman That's good. Also make you're the main focus is on the effect of the abuse on your life and have your friend point that in their affidavit as well.

 

They want to understand the impact psychological or physical and quality of life in general.
