Guys, 

 

What are your thoughts about traveling with Advance Parole while VAWA is pending? I've been waiting to visit my country because my grandma is very sick, I want to at least say goodbye :( it breaks my heart not being able to see her one last time so I would like to apply for AP.

I do not have an attorney at the moment. I have since moved to another state. The only thing I've been able to do is doing my change of address through USPS. So far, I think USCIS did not remove my attorney on file or updated my address...

That situation also worries me because I do not know if my new one when I sent the FORM FORM G-28 automatically replaced the first lawyer, otherwise, it means that the first lawyer knows everything I'm doing.

Me too.. I called and emailed the attorney so many times. I don't know what else to do. I don't want him to receive more of my mail from my case :(

It would be nice if someone here in the forum with much experience would clarify if the fact that a lawyer sends the FORM G-28 automatically replaces the first lawyer and USCIS never again sends information to the first lawyer

I asked my lawyer his opinion about my case and taking the AP.  

I’ve been here for 10 years, and he said no. My chances to be denied to come back is huge. 

I really don’t know what to do. 

I already had my interview but no decision yet!! 

It’s Pending adjudication....

I feel so bad! Everyone gets their decision and I’m not!!!

Yes, I'm scared I won't be allowed back in the USA... I came with tourist visa and overstayed 2 months.

I am not an expert but what I have read about your case is that the people who have traveled have Vawa approved. They have not had any problems if they have to prove the reason for their trip, even I know that the lawyers do not recommend traveling. That is a personal decision that you have to make, make the decision that feels most comfortable for you.

It's a gamble. Many people travel on AP with no problems but some people don't make it back. Personally I don't think it's worth the risk unless there is an emergency.

I traveled through Canada and was fine but I have never been out of status. I don't plan to travel again until I have my green card. I don't think it's worth the risk and I definitely would not travel if I came over on a tourist visa and overstayed

To end representation, your old lawyer needs to send a letter to USCIS informing them that he/she is ending representation for you. After that, your new lawyer can send form G-28 with his/her name. But representation is not ended until formally sent to USCIS by the old lawyer.

It's really up to you. But I take the risk and I came back without problems. We have the same situation.

So my old lawyer is still getting the correspondences even though I change my address in USCIS?

Hi friends 

i have a question because iam a liltle bite confused ..

the last time i enterd the states was december 2016 on tourist visa and i was gauranted 6 months  .. and i filed my i485  and i130 application with my husband May 2017 .. after this my husband started abusing me and he went with me to the interview And he withdrew the case .. this was In september 2016 .. then i filed the vawa febraury 2018 .. 

my question is .. since when iam considered out of status ?! Because i want to use my AP for emergency purpose and i am very scared because of my situation !
