no, i have filed for a protective order against him because he assaulted me and the cops  got called and he got charged with a second-degree assault and on that ground  the judge told him to stay away from me and not to contact me or harassed me or do anything to harm me or he will suffer the consequences. But he never stoped

Then you are ok my dear ,, just make sure you dont even talk about your case with his family.remember they are blood family and they can imform your ex hubby ' whatever is goi going on with your case .remember to pray God will always make away where there is no way... Ihope your ex hubby said nothing to uscis... If you are working just work hard and take care of yourself... Iknow how pain full this journey is.... we all need  God intervation.

im sure he did contact them and that's my worry and i hope so too tnx for the kind words

If he did contact uscis and tell them something bad about your marriedge  They will honor what he said to them... Dont give up ,,keep waiting and checking on them .if you have valid evidence of abuse, they will help you ,,, idont think it has be physical evidence always..  they will consider you and approve your case...

It really varies, i don't have timelines handy at the  moment but I remember whene sent my renewal form last October 2017 I got the NOA promptly  then I received my new EAD mid December.... It was better than the first EAD cuz I waited for the NOA about a month on the first round! I guess it's up to the employees handling our paperwork :/

 

This year most timelines stretched even more so send it soon and don't stress, it's just a matter of bureaucracy sometimes.

Timeline: 

May 2016 retained an attorney and started to prepare my VAWA petition. 

11/08/2016 mailed my packet

11/28/2016 USCIS rejected my packet (expired forms) :(((  

11/29/2016 Mailed my packet again Via ExpressMail (I-360, I-485, I-864w, I-765, I-912, G-325A) with previous rejection notice on top & a request to expedite EAD

12/14/2016 Date on the NOA  

12/31/2016 Attorney emailed my Prima Facie (Notice date 12/19/2018)   (180 days)

Naperi, if the abuser contacts USCIS and says that her marriage was a fraud, USCIS will consider what the abuser said as a truth? without taking into account what she says about her marriage?

Iknow when it comes to that situation where the abuser said the marriedge was  fraud then uscis will deny the case.. But in her case we are assuming. We are not sure if the abuser said something.  to uscis or no..thats why am encouraging her not to give up.. If abuser did not said anything may be there is something that is making uscis to take that kind of long time..this journey is stressing and long idont. Want to speak something disappointing ..am also in the same boat waiting..remember we here just helping one another some information are true some are not true

Hi, all

I filed for i-360 in Nov 12-2017. I received a RFE on January 31,2018. I responded to RFE and it was received by the USCIS on March 12. Since then my case is pending . My question is should I have received a prima facie or am I missing something? Do I need to just wait ?

 I renewed it 3 weeks ago. Do we have to get our employer involved? I renewed it by myself.

My abuser always threatened me that he was going to call USCIS to deceive that the marriage was a fraud, and I think he really did it when we separated. Then it means that they are going to deny me the case? I thought they listened to both parties before taking an accusation as true. please clarify this doubt .... thank you.

USCIS looks at the whole big picture. He saying he’ll call immigration and say that it is fraud can be a part of his control and abuse. Let’s relax. As long as you have the evidence of abuse you’re good on that part

Uscis will not considerate anything that your ex husband tells him.Vawa Law prohibits USCIS to take into consideration any information provided by the abusive spouse.
