1)  The current August 30th "processing" date that USCIS states DOES NOT mean they have not touched petitions that were received after August 30th.   We all know that is not true and should not be interpreted that way.  What it is does mean is that if your petition was received after August 30th, it is considered to be with in normal processing times.   The USCIS does not want you to inquire asking for case status if your I129F was received after this date (August 30th) and likely they will not be helpful to you.  The UCSIS processing time page explicitly states :

 

"We have posted a Case Inquiry Date in the table below to show when you can inquire about your case. If your receipt date is before the Case Inquiry Date, you can submit an “outside normal processing time” service request"  https://egov.uscis.gov/processing-times/

 

2) Please try not to stress out or become depressed if you see other petitions approved before yours, even if they were received by the USCIS after yours.   The reality is that some cases take 90 days (or more) after the first one for a given date is approved.   Try hard to set this expectation for yourself and your fiance(e).   Try to remember patience is important to survive the K1 Visa process and also for a successful marriage.  You will need to learn to be patient, if you are not already able to be. 

 

There are sill folks receiving approvals who filed in August, July, and June.  In fact, a July filer who has run the July scans just received his approval this week.  Set your expectations correctly and you will do ok.  (and do not listen to the Lawyers.  ;-) . 

 

Why some petitions are processed faster than others is for many possible reasons.   But ask yourself these questions that might help explain why yours is taking longer than someone with a simpler case.

 

1) Have you or your finance(e) been married before.  If so, they need to confirm you are currently able be married.

2) Do you or your finance(e) have prior arrest records.  If so, they need to be reviewed to ensure the candidates are eligible for a K1 Visa.

3) Do you have a common name like John Smith or Karen Jones, or have multiple aliases.  If so, they need to be sure they are looking at the correct bio background data for you.

4) Have you or your finance(e) traveled frequently and where to.  Some locations my be under travel advisory and there may be need determine the travel was for legitimate purposes and visa conditions were honored.

5) Are there K2 (children) applicants attached to the K1.

6) Were 50+ pages of supporting relationship evidence submitted that need to be reviewed.

 

It is my belief that the simpler the case, the quicker the initial approval.  More complicated cases will reasonably take longer amounts of time.

It is not strictly a matter that cases are not processed in order.  Many cases are being processed in parallel.  Some may take a day to approve, some may take 90 days to approve.  If processing were handled strictly in sequence, they would probably still be working on year 2003.   

 

Time or a "Computer Nerd" analogy.  One reason computers today are much quicker than computers from 30 years ago is the advent of parallel processing.   Some tasks can be completed in parallel with other tasks and they do not need to wait for a slower task to complete before they can begin.  In some cases a newer task will complete before an older task.

 

One last thought.   We are all in this together and if everything is legitimate with your application, you will eventually get your petition approved.  :-)

 

 

I think this is awesome read although I lost the belief of “simple cases goes faster” as all of my answers to those questions are “no”

 

however I do believe all these are correct. Thank you for putting this together.

But I wonder if your case is as simple as we think.  Although I only know what you have shared here at Visa Journey, if I am not mistaken, you are originally from Turkey and now living and working in Japan, and you have visited the US at least once.   Although it is believed that the NOA1 -> NOA2 phase mostly focuses on the petitioner, and you are the beneficiary, perhaps these are things they are looking at.  (no need to answer here, but they maybe looking to determine why you left Turkey, what you are doing in Japan, and how long you stayed in the US)  Perhaps that required a second level security check?  Just maybe.   But we will see.   Since my case is simple, I do hope yours will be approved soon, if only to validate my theories that will work in my favor also.  LOL . :-)

I was a government scholar on government scholarship of japan because of my 4.0 gpa for 7 years since 19, and working in one of the biggest Japanese companies hence I live in japan....so there’s not much conspiracy there.....

 

i visited us 6 times having a 10 year multiple entry b1/b2 visa for 7 years now....only California and Florida (I believe this is as touristy as it can get)...

 

by the the way I am open to any theories (like extremely) because simple cases faster time was also my theory...

now lets go with the second prt of theory (cause I’m really bored at work 😔)

 

now i believe after one clears all this and background checks (which I have been told that our case was assigned before March 8 and before that in January I know our file was still in background checks) I believe at this point the speed of the adjudicator and the number of files they are going through per adjudicator is in affect. What do you think?

 

cause I sincerely believe I got to someone’s desk and waiting there....

First, there is no doubt in my mind that there is any conspiracy here. :)  Clearly your accomplishment in life are impressive.  I think I mentioned to you once before that California is the right place for you. 

 

But my guess is that these are events (and clearly positive events that represent you well) that the USCIS might review.  Maybe not, I really do not know.  

 

In my case, my Fiancee has never left her county, to live abroad or visit the USA.  It is difficult to get a US visa in Thailand.   So, is my case simpler?   Maybe?   With my luck though, I will be waiting the additional 90 days and I can toss my ideas into the trash.  :jest: . I hope I am not jinxing myself.

Ok, if you have passed the background checks, then yeah, you are on the desk of the lazy adjudicator.  :rolleyes:  Hopefully they are not too slow and have not spilled their bean burrito on your evidence and need to send the dreaded RFE.  :rofl:

I do believe if someone never left country it should be simpler! (I hope I’m not jinxing you either but don’t worry I’m an unlucky person by birth nothing came fast to me always took more time than it should including that scholarship— however when I act positive for other people they usually get good things 😉... I mean look around me all my buddies got approvals :D which is the slightly good part of this all!!) soooo based on that paranthese your case should be much simpler!

With the new system in placed, is silent NOA2 still a thing?

 

I'm getting nothing from both systems so can't help feeling disheartened. Silent NOA2 feels like the only hope now.

I couldn’t confirm that yet cause the system is still new. But so far I believe what used to be silent appears in the new system. As many people who got silent confirmed now they can see it in that system as an approval.

 

not all cases update in the new system, and not all cases update in the old system, sometimes both happen. But I couldn’t confirm when it doesn’t happen at all.

I think I read somewhere that your fiance was/is in the military? Have you ever tried to visit him on base while in Japan (assuming that's where he's stationned) or on base stateside? If I remember correctly, there are several countries which are not permitted to enter a US base overseas. Maybe this could be a reason for the delay...? Just throwing a theory out there bc/ you said you were open to any theories. In the end, I'm sure it'll all be fine!

Nope he is out of the navy since a year ago (also just to note cause he would kill me: not out of, not quit, it is an honorable discharge Yada Yada) but I can go into the base... I just was there visiting my friend last week...

 

by the the way I am loving these theories!! :) seriously makes me at least think!!
