Thank you love!!❤️ Do you know if it has to be notarized since it's coming from the Dominican Republic so they can say they witness it was him who signed the intent ?

Well, for me, it doesn't need to be notarized. If it somehow eases you from worries, you can have it notarized then. BTW, I'm the beneficiary and in my case,  I just signed it with my wet signature and mailed it to my SO.

We got an RFE :(  Anyone knows how long that's gonna take?

Each case I'd different, but an RFE is not bad.  Just send them the docs asked for and all will be fine. I was surprised I got an NOA2 3 days after they received my response to and RFE.

Yes, you need an actual wet signature of him signed on the letter of intent to marry. That's the only document USCIS asked you to send to them. I'm not sure if you need to send the rest of the paperworks.

@Amberperez10

The USCIS recently released a memo on signature requirements which indicate that photocopied or scanned signatures are valid, so a wet signature is not required.

https://www.uscis.gov/news/news-releases/uscis-finalizes-guidance-signature-requirements

"A signature is valid even if the original signature is later photocopied, scanned, faxed, or similarly reproduced. Regardless of how it is transmitted to USCIS, the copy must be of an original document containing a handwritten, ink signature, unless regulations or the form instructions state otherwise. USCIS will not accept signatures created by a typewriter, word processor, stamp, auto-pen, or similar device."

https://www.uscis.gov/sites/default/files/USCIS/Laws/Memoranda/2018/2018-02-16-PM-602-0134.1-Signatures-on-Paper-Applications-Petitions-Requests-and-Other-Documents.pdf

My interpretation is that a scanned copy of an original signed document could be transmitted to your finance(e) (via email, dropbox, google drive, etc), so sending signed documents via standard post (USPS, DHL, etc) is not strictly necessary.

That's cool..!  If I knew this, I shouldn't have sent it thru fedex. Anyways,  we were approved. 😊

Same. 201 days for us too.

We’re also gonna give it about 2 more weeks. When fiancé called last week he said we should hear something within the next 2 weeks. Otherwise we should call again. So that’s what we’re doing. Wait... pray and if nothing, then call.

Thank you so much! So I should simply use the example intent to marry template I've seen people show on here and have him sign it and scanned back to me ?? Sorry for so many questions just want to get it right 😩

Hello guys we got an rfe the 14 and im september 5 btw. They have asked for a letter of intent to marry. I wanted gently to ask if its fine to send just the letter with scanned signatures or you actually need any other proof beside the letter and wet signatures? We are stuck not knowing what to do our lawyer said a proof would be better but we do not have made any wedding plans or things like that. And also is that bad we are waiting this long to send the letter back? Anyone experienced the same rfe what did they do? thank you in advance

Wet signature and we had them notarized. Yeah proof of wedding plans will also help your case even if you haven't made solid plans. I already have a place but didn't make a deposit. I sent info about my venue and number of guests etc along with other types of proof they ask for such as, text messages, photos, proof of visit(s)within the last 2 years. Anything that shows that yours is a bona fide relationship. Good luck! I hope you hear back soon after you send in your rfe.

According to the memo from the USCIS, this should be fine.  If you are nervous with doing so, there is nothing wrong with using standard post to have him send the letter with a "wet signature".   Better safe than sorry?   Others posting here feel that is the best thing to do.   With that being said, I am not aware of any RFEs that have been sent to petitioners due to a lack of a "wet signature".    I recommend that you do what will give you the best peace of mind.    There is no need to add more stress to yourself if this is something you are going to worry about.   A wet signature is for sure 100% acceptable, and according to the memo, so is a scanned signed document.

If anyone can point me to a thread here on Visa Journey documenting a case where the letter of intent was rejected due to the signature not being wet, please post a link.  I would like to review it.   There seem to be many myths shared here on Visa Journey and I currently think that the requirement for a "wet signature" is one of them.  :huh:  That being said, there is nothing wrong with using a wet signature, and is probably the preferred option when possible and practicable.
