Timeline

Hello, 

I need advice. So, things are not going great with my husband and I. He just got his green card in January, and all of a sudden has started acting funny;hewants to leave, he hates his job and wants to quit and he even started conversing with another woman. What are my options here? I honestly don’t think he came for the right reasons, but i have no proof. And i don’t think that it would be fair for him to stay here in the US. What can I do about this?

If you don't want to be with him, divorce him.

 

 

He already has his green card. There is nothing you can do about his status.

He can leave and do whatever he wants, in 2 years he will face problems removing conditions without you. (especially if he doesn't have proofs of bonafide marriage.)

Like above, also remember you signed affidavit of support which you are on the hook for. 

 

Also to note, as you said, you have no evidence of anything.. he has his green card.. what's done is done, whether it's "fair" or not. That is the risk of sponsoring someone.

That sucks! I feel for you but nothing u can do. Whether he came here for the wrong reasonable not you aren't the first to get used and won't be the last.

How long did u date him before? Did you meet his family? We're they involved in the wedding? Is he alot younger then you?

 

Unfortunately u can't report him. Lol he has his Green card and can apply for roc on his own.

I am sorry that you are going through this, either you can talk it out with him, or if you feel he just didn't come here for the right reason and want to end it then divorce is your option.

you don't have evidence but you can gather some as any American woman would do

then go to an attorney and sue for divorce with your evidence asking as a wife for allimony as he has a green card and a job

have the attorney to offer an agreement to take you off the support order in lieu of allimony as he can now support himself

and don't let him talk you into helping him remove conditions in 2 years

get tough

I don’t have anything to add other than what’s been said but I am sorry to see you’re experiencing this. What makes you think he came for the wrong reason? When you say he wants to leave, does he want to go back to JA or just leave the relationship? Is the woman here or in JA. Just asking because could it be that he’s just having a difficult time adjusting in the states? He got his GC in January, he could’ve left already unless he does not have anywhere else to go? Hope you guys can work it out🙏🏽

He already tried to leave and called the police and i hit him, which i didn’t. He knows that they would let him stay for domestic reasons. The girl lives here in the states and he had still been communicating with her out entire marriage

Well if there is any police report officially filed for this alleged domestic violence (you hitting him, again allegedly) then he may be able to proceed with VAWA regardless. Again it is the risk of sponsoring someone either for K-1, spousal visas....

Thats good; but need to be careful. You'd be surprised how 'aware' people are of ways to stay lawfully while using their spouses. Like a lot have said, collect what you can, divorce, be done with him if it can't work.

So what happened when he tried to leave? He came back? They think they have knowledge of how to work the system once they get over. Unfortunately there is nothing you can do about that. If he plans to remove conditions based on  VAWA, I believe the burden of proof is on HIM to prove he entered the marriage in good faith. However, and not sure if it would make any difference, but maybe you can gather evidence to prove he that he did not🤷🏽‍♀️. Although you’re on the hook for the 864, you could still ask him to leave and dissolve the marriage (if it’s that far). The longer he’s in your home, the more opportunity he has to gather evidence to prove his case. Put that sucker out and let him survive on his own since he already has it figured it out....

And as a warning to Jass, if she is in the process of divorcing him for a sham marriage or has already divorced him by then, lying to have his conditions removed would be illegal.

These trolls and scammers know the system *cough Mohammed cough* they know the type of women go prey on, what to say, how to act and how to get out of it! 

I would just get him to leave. Do you have any joint bills? I think getting his greencRd so soon could be a tough ROC but I question how many ROC get denied  

 

This is why the embassy tries their best with high fraud countries but at the end of the day it's tough to tell a woman in love she is being used for a Green card. 

 

That's why I asked those questions you didn't want to answer. Their are many red flags and I'm sure if you go back and answer the questions I posted you would have an answer on whether he used you or not.
