Hello Guys,
I would like to show you my case, and see if somebody can tell me if I'm doing wrong.

I came to the US last september just to study for 1 month, but my wife wanted to stay more and live here (she is american). So, we married here last december.
My i94 is valid until march 16th, next friday. So, las week, I sent the application documentos to the USCIS in chicago.
my apply consists, basically, in: FORM applying for the FEE WAIVER; I130 and 130A; WORK PERMMIT, ADJUSTAMENT OF STATUS, TRAVEL PERMIT and our PROOF (I'll wait for the medical exams request to do it).

My doubt:

- as my i94 is valid only until this friday, what should I do? just wait, or leave the country?

- Does the FEE WAIVER apply delay my process, or can make it difficult and get my green card more difficult to be ok?

- I put my wife as my sponsor, they could deny it or the fee waiver for conflit of infos (don't have money to pay the fee, but have money to be sponsor)?

The number are ok, because we are under the poverty line, but up the line for the sponsor, but I don't know what could happen.

Why do you think you qualify for the fee waiver? 

 

If you don't, I would expect the package back at some point, but you could be waiting up to a month to receive it back.

 

Therefore you'd be accruing unlawful presence from Friday onwards until you get your NOA's confirming they are looking at your case (that's if you don't get your package back and have to resend it with the fee). Once you get NOA's, unlawful presence is forgiven as you're a spouse of a USC.

03/02/18 - AOS Sent 

04/02/18 - Biometrics appointment @ Field Office

04/16/18 - Courtesy letter received re: Medical

07/17/18 - EAD card in production, AP approved

07/21/18  - Combo card in hand

10/18/18 - GC Interview  (Approved on the spot)

No fee waiver for AOS - can you not read the instructions? 

 

They accept credit cards now - pay that way? 

 

Alternatively, leave on time and have wife I-130 for you. It will take a year but she can get a job that fully satisfies sponsorship requirements.
