We had our interview on March 8th.  They put us in AP and requested more proof of a relationship and did not keep his passport.

 

We submitted hundreds of pages of chat and call logs, my visa stamps into Nigeria (I've been there 4 times in 4 years), a lot of pictures.  At the interview the CO said our chat and call logs were not sufficing for him.  I'm not sure what more that they want.  We gave receipts of things we did together, going to the movies and out for meals- the CO asked how he knows that he actually took me and not someone else.

 

I'm gathering more chat logs and phone logs, a copy of the approved I-601 waiver, chats between myself and various members of his family, pictures of me and his family, chats between him and my mother, my lease that I put his name on in thought that he'd be here by now, my retirement where he is listed as the beneficiary, a signed letter from my best friend acknowledging our relationship and her communications with him, all of our emails between one another, facebook activity, copies of letters and cards that we've sent one another, wedding plans, pictures of our wedding rings...

 

Is there anything else that would be beneficial?

Chat logs are not really great evidence to be honest. I would say actual phone logs, pictures, hotel receipts with both names on it, maybe add each other to each other’s life insurance policies, add each other to each other’s phone plans, things that show both your names on it. I’m not sure how well received affidavits on the relationship from of friends and families are either.

Wow saying that I feel extremely sorry for your case is an understatement. Can’t imagine what you guys must be going through waiting for 3 years now.

 

the thing is that LAgos is considered a high fraud embassy and the rates of denials are really high even for spouses. Chat logs are not sufficient. How long do you stayed with every visit?

 

I’ve seen many couples with your exact same case and they ended getting married in nigeria and then apply for spouse visa...which unfortunately, doesn’t have significant better chances. But what can make a difference is how long you stay. 4 visits in 4 years sounds great but the amount of time is as important as the amount of visits. Consider making a longer trip, get married and apply for spouse visa

We're not in the same country to put one another on phone plans, Nigeria and the us have completely different service providers. 

I sent hundreds of pages of call logs with the petition as well as to the interview.   All the receipts of things we did were included already and we stayed at his house each time so there's no hotel receipts.

I've stayed about 3 weeks each time.   I've already gotten an approved I-601 waiver detailing why we chose not to marry and be separated, also why it's not feasible for me to live there with him.

I've been there for 2 of his interviews even though they don't allow us inside the embassy.   I can't leave for that long- Lagos is very unsafe for me, people getting kidnapped all the time.

my thoughts to you is that people focus way to much on chat history and call logs. Sending 100s if pages only takes up the COs time to look through your evidence.  A few call logs and chats 2-3 each month you’ve  known each other and only chat logs that talk about future plans such as having kids, or him talking with your family and you his. If you have any pictures of him with your family or you guys doing stuff alone that is great. Make sure every photo is labeled with who is in it and what y’all are doing. The CO wants to see that you guys are planning a life together and not just going to go you separate ways when he gets here. 

 

 

Heres some ideas 

- Authorized user on credit cards 

- Apartment lease 

- resubmit evidence from your visits(plane tickets, tickets from movies) 

- Affidavits from both families(may or may not hold any weight)

- screenshot of video chats between his family and you , and your family and his) 

- Wedding plans(receipts,etc) 

- Pictutes( with family members, and spending time together) 

- Relationship timeline (beginning to end) 

- if you have an international phone plan, include the call log for only when your in Nigeria. The log will show your location. 

- Any Facebook announcements about your relationship showing each other friends and families commenting.

Sorry for difficult process but in my mind; because you guys met online and Nigeria is a high fraud country when it comes to the internet it raises a immediate red flag to the officials; my suggestion to you is have a wedding in Nigeria, than submit the necessary paperwork for married couples; we have our interview April 25, 2018 and if we are not issued VISA,  I will return to Lagos, Nigeria immediately to have wedding and return to United States and resubmit my paperwork for married couples;

If not issued a visa within days or a couple weeks after the interview it would mean you are on AP.
AP could take weeks or some months and it would be totally silly to marry and wait 12-18 more months
for a CR1 when a K1  visa would have been issued after a short AP time.
Unless a petition has been returned to USCIS there is no sense in marrying and filing a CR1.

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

No, she should not ditch the K1 and marry and file a CR1.
The CO requested more evidence and that is exactly what she should do, bring more evidence.
If the petition has been returned then yes, she can marry and file for a CR1.
Otherwise they could have been issued the visa in a couple weeks or months versus waiting 1 1/2 years for round two.
Once married a K1 visa that is hanging up in AP can no longer be issued.

Of course a K1 is useless after getting married. Duh. She said they returned the passport and that’s usually a bad sign. They’ve already been denied K1 before so that’s why I said ditch the K1.

Bad signs and facts are two different things. To advice anyone in AP to ditch their K1 and marry and file a CR1 is bad advice.

Many have received a visa while the C O didn't keep their passports 

after the interview. Until it is confirmed that it has been returned they need to wait.

Expedite request for EAD/AP Aug 3, 2016, Aug10 notification >request was received, assigned, completed. RFE letter requesting evidence for expedite, docs faxed Aug18

*Service request for I-485 Aug 3, 2016, Aug11 notification> request was assigned. Service request Dec 2, 2016.
AOS Interview letter received Aug 12, 2016

Second Biometrics appointment letters received for EAD and AOS on Aug 15, 2016 for Aug 17 ( 2 day notice).

Third Biometrics appointment letter received Aug 19, 2016 for Sept. 1, 2016. WTH ?!

EAD/AP (renewal) approval Aug 22, 2016, NOA2 received Aug 25, 2016

Renewal EAD in production notification text and online, expedite successful 4 days after RFE request response was faxed, Aug25mailed,Aug29received.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

The spousal visa is not a viable option for us.  I hope your K1 works out!

01/2017- Embassy requested interview. 
04/2017- Fourth visit to Nigeria.  K1 officially denied. 
04/25/2017- NOA1 for 2nd K1.
07/27/2017- Case transferred to TSC.
11/17/2017- Case transferred back to CSC.
01/16/2018- NOA2!! (266 day wait)
03/08/2018- Interview (AP)
05/03/2018- VISA APPROVAL!!!
05/14/2018- Visa issued
05/18/2018- Visa picked up
05/25/2018- HE'S HOME!!! 💙💙💙
