Hi everyone,

 

Facing a difficult situation. I moved to the US in February 2017 through a fiancé visa. We got married as soon as I got here and I received the 2 year greencard at the beginning of September 2017.

However my husband and I have been through difficult times and we are both wondering if our relationship is viable on the long term... We decided to take it slow and take some time to think and see how we want to move forward.

 

Of course my immigration status comes into question. I do believe he would be supportive enough to stay married until we file for the 10 year greencard. However I prefer anticipating the worst options.

I know that in case he wanted to divorce before we applied for the 10 year greencard, I would have to bring proofs that our marriage was real.

My question to you guys is how difficult is it to convince immigration that our marriage was real? Has anyone been through something like this?

Plenty have done ROC with a divorce waiver, immigration knows that marriages do not always work.

 

should it happen gather as much evidence as you can joint accounts together, photos anything that you can think of, show you have tried to make it work, if you seek counseling keep those records in the case it doesn't work out.

 

plenty have been able to remove conditions with the divorce waiver.

Thanks for the answer! I have seen on many websites the mention of counseling. We mentioned it but to be honest I do not think that is going to happen. I just think we have reached a point where we notice our incompatibilities too frequently to make it viable. I am just wondering if not having that kind of proof (i.e. counseling records) is a killer or not.

We do though have lots of photos together, trips taken, bank accounts, etc

make sure you have a copy of all of those, showing you had at least attempted to make it work, not everyone goes through counseling, but it is good to have those records, can't make one go if they just feel or if both feel it isn't going to make a difference.

 

I wish you luck on your journey, I know that it is hard going through a divorce I have been there.

Hi my first marriage was rocky but I wanted to make it work. We filed ROC jointly however he moved away not long after that. Then we got back together and separated again. In the end I received my 10 year green card and we tried to make our marriage work for another year but we couldn't. I ended up filing for divorce. We didn't have any counseling together but I had some by myself.
