Tourist visa for Kenyan Spouse

The OP is in a bit of a no win situation.  She has family and a connection to the USA and would like her Husband to be able to spend time with her in her home country and the two of them continue to live in Kenya.   But because he can't over-come immigrant intent the only path I see forward for them is to go the CR1 path, get the Greencard and then surrender it after the first trip to the USA hopefully get a 10 year tourist visa at that point.   Alternatively, they would get the GC and assuming they had been married for more than 2 years then He would be eligible for citizenship in the USA after 3 years assuming they spend enough  of those three years in the USA without long absences.. Then they would be free to live and travel between the two countries.
