Tourist visa for Kenyan Spouse

Am a Kenyan citizen too here in the USA now.

I am afraid due to his ties to you, the Embassy (no matter where) will in all likely hood deny him a B1/B2 visa. You are also renting which does not help. I was thinking maybe Canada but they are just as strict since you could visit him (a lot nearer) if he would stay with relatives.

 

Best is to get to the USA and take care of your father alone,

BTW, Delta Airlines now has non-stops to Kenya (not sure if currently, or in the very near future) which might make it easier for you?

we no longer do K3 

it is CR1 for a spouse

renting a house is not a strong tie as it is easy to abondon

owning property is 

owing o busines is

having a job is

in most cases (high fraud country) a tourist visa is denied for a spouse as the intent to immigrate in always an issue

The reason your husband is a high risk is because he can adjust status through you in the US. Many people do that because it is kind of a way to skip the line, so to speak. It is because people don't want to be separated for long periods of time which is something you already admitted to in an earlier post (not insinuated that you are going to do it).

Basically I just want to be able to go to my home country with my husband, I don't know how long I will need to be home. It could be 2 months it could be 6 months. If we have a C1 does he then have to stay in the country? This is quite confusing.

It's confusing because you are not familiar with what visa types are available.  Please research using the above links.  Read each category carefully.

What you want and what options are available to you may be two totally different things.  Prepare to adjust your plans.  Visitor visa's (Category B) are very difficult to get from African countries as the others have stated.

A CR1 is for immigration as the spouse of a USC.

And yes, the CR1 would mean he has to remain in Kenya.  He would not be able to enter the US until his CR-1 visa is approved.  Which could take a year.  Or more.  A CR-1 is not an alternative to a tourist visa.  If he has no plans on immigrating to the US to live in the US permanently, then it makes no sense to apply for a CR-1.

 

The ONLY option your husband has to accompany you for a short visit in the US is to apply for the B1/B2 visa for purposes of tourism.  The criteria he would have to meet for approval is already mentioned in previous posts in this thread.  Again, based on all that you have mentioned, the chances of him being approved are quite slim and you will most likely end up having to travel to the US by yourself to care for your father.

Even if he were to get a B2 visa (highly unlikely), his length of stay would be limited to what the border officer gives him upon entry to the US......and it most certainly would be 90 days or less....

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

You want to visit your dad, then go and visit. Taking your husband along may not be possible because a Visitor Visa is unlikely. My question is this presents many issues, he is from Kenya (High Fraud) but according to you you want to remain in Kenya but you have been residing in Asia for a while. Too many issues... if you don’t plan on living in the US go alone without your husband, then return. When you do decide you may want to live in the US, you may be able to Direct Consular Filing, after receiving your Kenyan Residency, if the US Embassy allows that for Kenya, which can take maybe 3-4 months as opposed to a year and a half.

If the most of time you think you will stay in US is 6 months then I'm pretty sure your husband can "survive" on his own in his country if a tourist visa is not possible for him. No one died of this before. Many times when I had to travel to my home country to visit my family (and my hubby could not come due to his job) then I did it alone and were separated for like 1 or 2 months max. It sucks but no all couples can travel together all the time. 

 

If your husband is not granted with a tourist visa, then you will have to go alone and take care of your father and then go home to your husband. 

Hope all goes well with your father recovery.

Just would like to note: don't get totally discouraged by the replies here. A friend of mine is Kenyan, and her parents were able to get tourist visas to visit her here. That being said, they're middle class by USA standards, so better off than the overwhelming majority of Kenyans. You know your personal circumstances better than any of us. Can't hurt to try for a tourist visa. Best of luck to you!

With all due respect, Parents are totally different from a spouse who has a USC spouse.....so the reasons why the parents get Visas are 

a) Older age and won't necessarily stay and adjust or be illegal or work here

b). They usually want to stay in their original countries..

Is Kenya particularly difficult to get visas from? I was under the impression it was one of the “easier” African countries. Be that as it may, if the husband is able to contemplate an indefinitely timed visit of anywhee between 2 and 6 months, it does imply he won’t be able to show particularly strong work ties and that is a problem no matter where you apply from.

please apply for a tourist visa and let us know how it goes.

dont expect him to get a tourist visa either!!! Once they find out he is married to a USC it will ultimately be denied. 
also do not even THINK about lying and having him put down he is single! USCIS keeps these applications and that will get him a misrep LIFETIME ban to the usa.

 

IMO you should go visit your father alone and then if you want petition for a CR1.  Yes, it is an intent to immigrate visa \but this way in a year if you are still there he will get a greencard and can immigrate.
