Hello, 

I am beneficiary and my fiance is the petitioner. We apply for K1 visa in June 2017. We know each other from middle school in our home country; however, we started to talk on social media beginning of 2015. My fiance was already in United State and I was in United Kingdom. We met on summer 2016 and we decided we want to be together. Since we didnt want to be separated, my now fiance decided to have break in collage and move out for couple of months to United Kingdom until I receive a visa. The ladies that help my fiance fill out all the paperwork stated that she cant live in United Kingdom while we trying to get a visa. Therefore  in December 2017 my fiance fly back to USA because we thought that my interview will be the latest in beginning  of January. However, the visa process takes longer now and my interview is scheduled on the end of March this is why in January we decided that my fiance will fly back to United Kingdom and when I receive my visa we will fly to USA together. She contacted a lawyer to ask if she can live in United Kingdom while we try to get visa for me. The lawyer said that it is her personal decision where she want to live during the visa process. We are worrying if she can actually live in United Kingdom since we heard different opinions about that. My interview is in a week and i am not sure what to say to Embassy officer and I am very stressed.

Unless she has an EU passport, she needs a visa to live in the U.K. Just as you need a visa to live in the USA.

She can visit the UK on her American passport for 6 months. Do  you have a plan for how she will qualify to support you if she is not working?

 

The embassy officer has nothing to do with who lives in the UK. He will be an American. He has no say in who can and can't be in the UK.

She have dual citizenship EU and US so she was traveling on her EU passport to UK and on their US passport to USA.

She was traveling to UK on her EU passport. She never got a visa to come to UK. If it comes to the support, her mother filled out special form and post it to UK with her taxes.

Having an EU passport makes a difference. Your interviewer shouldn't care that she is currently visiting the UK.

You need to be wording it differently. If they are coming for a short period of time it's not living in the UK, it's visiting you in the UK, which is perfectly fine. 

Even if she was in UK for over a year and she was working in UK I can state that she was visiting UK not living here?

Issue is irrelevant.

I don't understand, if she was working here then she must have had a visa? 

 

Anyway, none of this matters because the US embassy is not going to care less about your fiance being in the UK and how or why she is here. They only care about US immigration.

She doesn’t need a visa because she has European passport and if she is European citizen she can work in UK without a visa. Like I mentioned she have dual citizenship American and European because she was born in Europe but she lived in USA for years. Anyways thank you! I feel a lot better and less stressed now.
