If they were not aware of the uncle dying, they wouldn't have known to refuse the visa, right?  Sounds like further information was not disclosed to the consulate (again).

In any case----no, your cousin cannot sponsor you----just to clarify, you said the sponsorship was transferred to your cousin (which would be impossible)....do you mean "transferred" as in your cousin is going to TRY to sponsor you all, instead?   

 

Or perhaps the consulate was not told the entire truth and is not aware that this person is "only" your cousin instead of a sibling?

... that is something vital for your visa process. Of course you have to inform immigration about the petitioner death. 

Looks to me you didn't tell them because you knew you won't get a visa then. Then another misrep didn't help either. 

 

Like I said. It all doesn't matter now. You are not getting a visa. And with misrep on record I doubt you'll even get a torusit visa ever.

If it's information that is relevant to the basis of getting a family reunification visa, then yes you do have to disclose it.  

Your uncle being alive/not alive was extremely relevant.

I am sorry for what happened but your father misrepresented so there will be no visa. Dont struggle cause they will not consider your appeal and nobody can help you and dont waste money on lawyers or anything like that. Just move on with your life. Sorry but its the truth.

Petitions do not necessarily die if the petitioner dies. There can be both substitute sponsors under 204(l) (this sounds like what happened in this case), and humanitarian reinstatement - both of which can potentially offer relief to beneficiaries after the original petitioner dies.

 

But the biggest issue here is your father's permanent bar for material misrepresentation. As has already been stated, this basically puts an end to your attempts to immigrate under this petition.

I was thinking substitute sponsor but seems like they just tried to hide the fact the Petitioner was dead.

 

Not sure why no waiver would be available, now unlikely to be someone who could file a waiver from what has been said and of course nobody to petition anyway.

Your father is banned permanently from the US. There is no appeal, no waiver that can do anything. The rest of your family cannot immigrate on this petition anymore because the petitioner is deceased. They don’t have a ban, so they can have someone else petition for them or find another way to immigrate. USCIS will just leave this petition under AP until it expires. I don’t even think you can cancel it because the petitioner is the only one who can and he’s no longer living so...

You have to petition or request for a substitute sponsor/humanitarian reinstatement, no? They didn’t even bother informing the consulate the uncle was dead.

in any case they can only get green cards through the father who is ineligible, therefore no derivatives.
