I'm married to a Frenchman and I've been legally residing in France for a year now, with a cstudent arte de séjour that is almost a year old, and I have the right to have a carte de résident since I'm married to a Frenchman, except that my husband and I have decided to move back to the US and if at all possible do the IR1 visa with DCF to expedite the process.

The Paris Embassy website says that it will not accept I130 applications from non-residents in France on a temporary status, but seeing that I am not and have not been domiciled in the US and that here in three months I'll have to apply for a carte de résident if our immigration situation isn't cleared up yet, I'm not really in France on a temporary status because I have the right to stay here as a Frenchman's wife.

The embassy visa service is completely nul. We paid 30 EUR and the Indian man had outdated info about Adam Walsch. I've also faxed a letter and my husband has tried calling all the numbers posted on VJ, with no reply.

So my question to all of you is, what next? Should we go ahead and schedule the visa appointment because it's likely that my technically "temporary" status is not the "temporary" status that the Embassy was meaning to exclude in its recent announcement?

Also if anyone has any ideas on how to best contact the Embassy to get a fast reply, as well as how long we'd have to wait for an appointment, we'd greatly appreciate it.

One problem you will run into is DOMICILE and the I-864 form.

A sponsor, or joint sponsor, must also be:
  • Domiciled in the United States or its territories and possessions.

You will either need to show that you are in the process of re-establishing domicile in the USA, or show that you did not give up domicile by showing things like recent IRS returns.

Also needed for form I-864 is past year's IRS returns, US citizens are required to file returns every year, even when out of country, they may be exempt from paying taxes on foreign income, but are not exempt from filing the return.

You may want to read the instructions with form I-864 carefully since you will be the primary sponsor and will have to file that form in order to get the CR-1/IR-1 visa.
