Hmm, good question, I have always assumed that the answer would be yes, if you have a US Spouse and are seeking to Immigrate, not sure I have ever seen that specifically stated, seems obvious it would...

Those are my thoughts as well.....otherwise, it would be a very lengthy  across-the-border marriage.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Why don't you/your boyfriend seek help from immigration attorney?  Your case is very complicated, and I dont think you can get good help here.

September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)

October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)

November 10, 2011: Interview - APPROVED!!!

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

yes, i was babysitting a few time during my stay on B1/B2 visa. thats the reason for ban...

It's all right here. She broke the law and she's now paying the price. She had absolutely no right to work under her tourist visa and she showed no respect by breaking that rule. It may be sad, but it's also not wise.

your right on all accounts, It may be sad, It wasn't wise, and her punishment is certainly severe enough to make me feel bad for the couple as she actually got caught babysitting... blows my mind when the IRS wont even share the ITIN # of millions of illegally working illegal immigrants who pay taxes but they will go through a sad sacks phone to bust her for babysitting a few times... Of course I fully understand it s all about money, revenue for the government above all else should be the immigration motto.

It's not about other people breaking the law nor it's about how many times she worked. There's no way we could know how many times she did that. It might be 2 times or 200 times, you won't know because you weren't there. What is important is that she broke the law. Do not break the law and you will be fine. It's that simple, it's a golden rule everybody must follow.

I still feel bad for her.
