My husband-to-be works on a cruise ship.   He works on the ship for six months constant and then has 3 month vacation. We wonder if he will be able to continue working on the ship after we get married. What exactly is the process after? We are trying to make a plan for every step. I’m hoping for advice on this. Thank you for your help. You guys have become my life line.

Once your fiance arrives in k1 first step is to get married. Then you file AOS and include application for work permit. Current waiting time for that permit is about 4 months from filling. Your partner cannot work until he receives his permit. 

 

After he receive it he can look for whatever job he wants. I'd be careful with ships (especially when they leave US area). He needs a valid document allowing him to return to the US. Don't know if Advance Parole works in this case or maybe it will be better for him to pause his ship jobs until he had a green card in hand (about 12 months from filling aos).

01.04.2014 - Interview.

03.2015 - AoS started.

09.2015 - Green Card received.  

RoC

24.07.2017 - NoA1.

01.08.2018 - RoC approved.

Does he have a work permit or a visa? The K-1 will cancel out any other visa as you cannot have two statuses at once that have different purposes (one allows immigration intent, the other one does not). He also cannot leave the US until he has either his advance parole card or his green card. If he does, his adjustment of status will be considered abandoned.

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!
