I know right? "Uhm, I'm married, but can I pretend I'm not when filing my taxes?", what the heck...?

Thanks for your input. I never once said or even suggested that I am trying to pretend or deceive the IRS when filing my taxes. My OP was a question based on advice I had gotten from professionals in the field, but having my doubts, I came here to ensure I am doing this correctly.

Please make sure you understand what you are reading before you make asinine statements.

i noticed that people who file as single even when they are married often say they do so because their accountant advised them to do so. these kinds of accountants should be stripped of their licenses imho! they are supposed to be the experts and yet they are so irresponsible with their advises.

Yes you right, my husband and I had always filed our taxes with the same person, last year we decided to file separate and that person adviced us to file as head of house hold, thank god we found out couple of months later and we admended our taxes as married filing separated as a result we ended up owing $3000 dollars to the IRS. Thank god we made our last payment this month and I didn't have a problem and my N-400 was approved. Of course we fired that accountant

The fact that the spouse is an LPR doesn't really factor into the decision, only the tax tables dictate this.  Normally, filing jointly is the way to go.  MFS makes more sense if the spouse's income is very low, even if it is due to working only part of the year and would be subject to a very low tax rate.  Any preparer or online service will run them side by side and you pick the most favorable financial outcome.  That's it.
