  And as noted in my other post  - you already have the visa application in the correct name so you are good there

 

Still this has nothing to do with what I was asking. Previously I posted about her applying for a new passport. This was the purpose of her 2nd time going to CFO, to retrieve her new passport.

Say what?   I stated your wife will NEED TO OBTAIN A NEW PASSPORT.     I also stated that being the I-130 is already in her married name you are good to go there.   What more of an answer would you need...?

 

I gave you a link to the DOS website .. so you can get "just the fact ma'am" .  How didn't that information answer your question?

Yes the passport should be in her married name, to match the I-130 and eventually the visa.  :thumbs:  

 

Hopefully CFO won't play games much longer

 

(if you had filed the I-130 in your wife's maiden name I would have said NO to needing a new passport .. which is why I asked in what name you filed the I-130)

There is no point in arguing each other on misunderstanding.

 

I believe the reason OP is asking if the new passport with married name is needed is that his wife hasn’t been able to get the new passport. Her passport department is telling her to get the visa in old passport and then they will issue the new one. While your reply about need of new passport was good, your reply with “you are good to go” didn’t help the OP. Just pointing out the miscommunication.

Do they have a right to deny her a certificate? Has anybody heard of this happening? My wife thinks she is trying to extort money from here.

The visa will be issued in the name in the petition be it the I-129F or I-130, and the name in the passport much match the name shown in the visa.

There have been many that come through here where CFO starts demanding more documents, more this or that.  They use the clause "other documents" as needed with vigor at times.  Is  your wife a quiet or timid person?  

 

Give them every document they have asked for, your wife will get her certificate.

CFO is not looking for a bribe.  If anyone approaches your wife suggesting that she "grease a palm", take the time to report them.  A couple years back there was a man working there that would "hint about money for lunch" before issuing the certificate.. he got reported (and I still have the email from doing it, plus the reply from CFO) and he is no longer employed at CFO.

Just an update, my wife got her certificate this morning. Today she had a 'test' about the info contained in my previous marriage divorce decree. Abuse of power in every-way by the CFO office. Thankfully this chapter is finished.

It will just be a forgotten memory in a few months 

Just when you think you have TDS eradicate,  a new case shows up.

Great news!

 

There had been no real issues with CFO for the past couple years, now all of a sudden they are back to be "cranky" .  :unsure:     And yes, some situations and some Flipinas are like blood in the water for the sharks.

Thanks to another member helping with what to say if they gave her problems this time. I was fully prepared to seek counsel if they gave us an issue. Thankfully we didn't have to go there.
