Hi there,

 

A little bit of background info:

I (Whitney) came over here on a K1 visa in 2008 and became a citizen in 2012.

My husband and I started the I-130 Petition for my parents this past June and got approved in January.  My parents are still abroad and not in the country.

We've already filled out DS260 and paid the fees. I am now preparing the I-864 with supporting evidence package to send to NVC.

 

I'm a stay at home mom so my income is $0, and my husband is self-employed.  We file taxes jointly.

We are sponsoring both my parents at the same time and fall below the income guidelines for our household size.

We would be using my husbands income, our joint bank (checking) account, and one of our cars (title in both our names) as supplemental assets.

We would also use my parents' bank (checking) account to make up for the difference.

 

Is that allowed? How do we go about this? I am confused as to which forms we should fill out.

Do I, Whitney, fill out a I-864, my husband I-864A? Do my parents fill out a I-864A also?

 

On I-864 for Whitney do I list under Part 6 , Most recent total income 19a-19b-19c $0 ? Assets $0?

Then for 5a Assets from Form I-864A, Part 4, Item Number 3D for : Husband and then add the assets from our joint checking account and second car?

Or do I fill out our total income since we file jointly? and leave 5a blank, and fill out 6 Assets of the principal sponsored immigrant?

You need a Joint Sponsor.

I don’t think you can use the second car as an asset. As a reminder your household size will be you+ your husband + dependents (if you have any) + 1 ( for either mom or dad, not 2 because you petition them at the same time with different applications)

may I ask you a question about your timeline.

when did you get approved, Nvc received date and when did you get your case number? I’m waiting for my case number rightnow.

I read you can use a second car as an asset as long as you can prove you have at least one more working vehicle?

 

For the household size, when I was filling out the I-864 Under Part 5 Sponsor's Household Size, it set our household size to 5 (me + husband + child + mom + dad)

We are above the guideline income for our household of 3, not for the household of 5 which includes both my parents.

 

 

 

Timeline, sent package june 1st.

Arrived June 8th.

Received approval notice in November,

received welcome letter in Jan.

Started online fees and applications in Feb.

NVC Package in March.

About the car because they will count one for you and one for your husband. So if you have 2 car then there won’t be an EXTRA car for asset (my understanding, but you can ask for more opinion and exact answer).

about the household size there will be 4 in each application. you+ your spouse + your child + mom (or dad). NOT 5.

Your husband is not a joint sponsor. You need another joint sponsor (if your household income is not enough.) you fill out I-864, your husband I-864A, and if there is a hoint sponsor, he or she will fill out I-864.

I get what you're saying about using the second car as an asset, I believe you're right.

 

For the forms, just to be sure.

I fill out an I-864, my husband fills out a I-864A and then my dad would fill out a I-864 because we would be using their bank account assets, correct? They are abroad still. Or does my dad fill out a I864a aswell?

 

I still have a question on that picture you posted.

For my mom's package, I am preparing I864. She is named in part 2. Information about the Principal Immigrant.

My question is for Part 3, Information about the Immigrants you are sponsoring.

Do I select both 1 and 2? and then for Family member 1 - 3a-7 fill out my dads information? (like picture)

Or do I leave the second box unchecked and not mention my dads information on this I864 for my mom ?

Whitney fill out an I-864 and my husband would fill out an I864a?

I’m not sure about using your dad asset because I never done that before. Hope someone else can help you with that.

for the picture, you mark 1. Yes, leave 2 uncheck and not mention about your dad.

The sponsorship income levels are far less than needed especially when payments for health insurance for the immigrants are considered.

 

If they do not intend to get jobs immediately upon entry, you need to rethink your plan.  You need to get a job yourself at the very minimum; if you are bringing your parents to the US, you do not have the luxury of being a stay at home mother.

She may wait for her parents come and help with the kids so she can start working (we don’t know other people situation), so I think in this forum we should stop at paper work advice, not personal life (my opinion please don’t feel offended)

I’m a mother of 2 as well, and I was stayed at home mom because even I work for minimum just enough to cover baby sis and gas (for work). Sometimes thing is more complicated.
