green card ROC employment confusion

Timeline

Hey guys, my two year green card has expired and i have my 1 year extension letter. I know this serves as proof for lawful employment.

Unfortunately the I9 form (to get a new job) that must be filled out by employees and employers does not list the extension letter as a means of proof.

What have others done?

Timeline

This note on the USCIS website states that an expired green card is acceptable when presented with a I-797 extending it for 1 year.  https://www.uscis.gov/i-9-central/i-9-central-questions-answers/faq/may-i-accept-expired-document-form-i-9

 

The handbook located here: https://www.uscis.gov/sites/default/files/USCIS/Verification/E-Verify/E-Verify_Native_Documents/E-Verify Manuals and Guides/M-274-Handbook-for-Employers.pdf  also states that an expired green card and I-797 extending it one year is acceptable on page 16 (page 20 of the PDF)

 

Or you can just show a drivers license and your social security card assuming that the license isn't expired, and the Social Security Card is unrestricted.

are you a new hire or current employee? if you are a current employee, reverification is not necessary as stated on USCIS website. if new hire, NOA+Expired GC is a qualified list C document for I-9. you will also need to submit list B which includes drivers license.

Thank you CanadaToCT and bruceandbessie! Very kind of you both to help.

(Naturally i forgot to get my SS card unrestricted when my GC was valid - cant do that now!)

 

My potential employer is reviewing those links as we speak.

Shame this is not specifically stated on the I9 form and must be dug up.

Pretty sure you can still get an unrestricted SSN card. https://secure.ssa.gov/poms.nsf/lnx/0110211025#c1d

USCIS issues a conditional resident alien, who has applied to have his or her conditional status removed, a Form I-797 stating the I-551 has been extended for one year.

Accept an expired I-551 card accompanied by an I-797 stating, “Your conditional resident status is extended for a period of one year. During the one-year extension you are authorized employment and travel”.

In the Enumeration system, select "Expired I-551 with I-797 Extension" from the Primary DHS Document field on the "Proof of Legal Alien Status" screen. Enter the new expiration date for the I-551 card based on the one-year extension. On the "SAVE Verification" screen, enter the receipt number shown on the I-797 as part of the Additional Verification request. On the Summary screen, enter the receipt date in the Remarks field "
