Hi All,

I was in the middle of assembling the I-129f packet when I was diagnosed with test...lar cancer (all cured, I hope). I understand there may be special processing due to my condition. I heard I could get my local Senator's office to contact the Vermont Service Center and the National Visa Center to speed up my process. Also, I would need to file the I-601 since my fiance came here illegally fro Mexico. I understand Juarez has a special pilot program that approves I-601's the same day or shortly after. I may be fortunate in a sense that having cancer can speed things up on my behalf. Any suggestions or options??? Thanks for your help.

I'm sorry about your diagnosis, but I sure have never heard of an expedite due to an illness. Expedites are usually reserved for military personnel who are about to deploy.

Vermont is pretty fast anyway (33 days is the current average), so I suspect your journey stateside will be a fast one. And normally, most congressmen's offices won't get involved until after you've passed the service center's published timelines.

As far as the 601 and Juarez go - I'm not well versed in that. You may want to check out the 'waivers' forum on this site for information.

You can always call and ask and see what the immigration caseworker in your member of congress's office says - but you probably won't get expedited service (especially since you say that you're hopefully all cured - I'm guessing, this is just a guess, that a stronger case would be made with some medical records of urgency to back it up.)

But like TracyTN says, if you're processing via Vermont SC, you probably get what's effectively expedited service anyway!

I have to say that your one of the few people on here that really doesn't deserve to obtain a legal visa for fiance or otherwise. I read your previous posts and your questioning whether your fiance can use the fake SS# that she has and how she came here illegally. As soon as you found out she had a fake ID or came here illegally, which I'm sure you knew about a long time ago, you should have told her to go back to Mexico and go through the process like the rest of us. Then you talk about moving and wanting to use a PO Box. Why? If your moving use your new address. Most people I know that are using PO Boxes are those that are trying to hide from someone or avoid prosecution from something. Now you want to use a supposed diagnosis of cancer to jump to the front of the line even though you say your cured. If your cured then why would you want special treatment? Besides, what "condition" do you have now that your cured. My suggestion would be to tell your fiance to go back to Mexico and for you to go with her. This site is for people that are doing the right thing and following the laws of the country that they want to call home. Seems all you are looking for is special treatment, bypassing the laws, and thumbing your nose at the process.

Wow ken and mintra did you not notice that he IS trying to go about the process legally? Rather than asking her to stay in the country illegally, he is filing an I-129F for his fiance. There is nothing illegal about doing this, even if she is in the country illegally. She will leave for the interview or even before and she will be denied at the interview due to her illegal presence in the country. He will have to file a waiver for her and prove that he would suffer extreme hardship if her visa is ultimately denied and he has no choice but to relocate permanently to Mexico. He is recovering from cancer. He needs regular scans, tests, check-ups and medical visits with qualified and experienced doctors. Cancer isn't "cured". He has survived, and if he is lucky he will be in remission for the rest of his life. If not, he will certainly have a much better chance of access to first world medical care in the US.

I agree that is no reason for expediting anything - his petition will be approved at Vermont very fast and once he has received the paperwork from the consulate his fiance can go to the interview. Because Mexico now has a pilot program in place for waivers, the waiver will most likely be approved in a few days. But there is no good reason to beat the guy up when he is asking questions about going the process in the most correct and legal way.

p.s. "Most people I know that are using PO Boxes are those that are trying to hide from someone or avoid prosecution from something" = HUGE assumption. Maybe he is concerned about where his mail will go when he is in Mexico with his fiance going through the legal fiance visa procedure.

Ok, fake SS#'s and ID's are used by 99% of illegal aliens. They need them to get jobs. And yes, I hope my cancer is cured, however I need further surgery this summer. PO Boxes in my area are common-place since it is very rural and there is no postal delivery. I am not hiding anything. As far as following the laws, my fiance has no arrest record, or even a traffic violation. She pays her taxes and has worked every single day since she came here over 7 years ago. Her only violation is coming here illegally and falling in love with me. I think that this is what this website is all about - Compassion.

If your fiance is already here in the U.S., why don't you just get married and Adjust Status?

Perhaps there are details I don't know/understand, but isn't the fiance visa used to get the fiance into the country? Your fiance is already here.

If she goes back to Mexico for an interview, there is a chance that she will be denied or even banned because of her very long undocumented stay.

I think you should get the advice of a really good attorney.

The only problem is, that having been here illegaly for as long as you say she has been, you may encounter a difficult time at the visa interview stage...or if you marry here and try to Adjust Status. How did your fiance come here to begin w/ on a legal visa, or crossed the border illegally? If on a legal visa, it means she has a significant "overstay," and that may mean she is banned from re-entering for a significant time (10 years maybe?). I'm not sure what happens if she came here illegally and has been living here as such for all this time.

You may really need to seek a qualified immigration attorney to answer your questions. Good luck!
