In more detail:

  • I got approved for a re-entry permit and left the US shortly after without it
  • I went to pick it up at a consulate abroad but discovered my name was misspelled (they messed it up)
  • I returned the misspelled re-entry permit requesting a corrected one
  • Have been waiting for 6 months (while still abroad) for any news about the new and corrected re-entry permit
  • 2 years is approaching since I left the US

 

1. What are my options for extending my re-entry, so that I don't lose LPT (lawful permanent resident) status given the above information?

2. Can I apply for new re-entry permit without holding the first (corrected) re-entry permit? Can I re-apply through a family member in the US?

I just want to make sure I understand, you have not lived in the USA for almost 2 years?

I'm a bit confused as well...you say you've been waiting abroad 6 months for the corrected permit, but then say you've been outside of the US for almost 2 years now....can you clarify?

correct me if I am wrong, but if OP has been outside of the USA for more than a year has the OP not already abandoned his LRP status if OP is a LPR?

The OP was approved for a re entry permit before leaving the US, so they are able to reside in another country for up to two years with that, and not have to worry about losing LPR status.

 

My confusion is if the OP has been abroad for almost 2 years already, and has been currently waiting 6 months for a corrected permit (due to the  name error), why they seemingly waited over a year (from what I gather the way the original post is written) to get it straightened out.

"Going through" described my circumstances correctly.

 

After I got my biometrics done and left the US, it took about 6 months for USCIS to issue my re-entry permit and send it to the US Consulate in my country. Since I live far from  this consulate I waited for several months to go pick it up. That is why it has taken this long. I never expected for them to mis-spell my name so I thought that I had plenty of time to go pick it up at the consulate.

 

Given that,

Can I apply for new re-entry permit without holding the first (corrected) re-entry permit?

Do I have to be in the US to apply for the permit? Can I re-apply through a family member in the US?

Two issues with this idea that I can see:

 

1) You can only hold/apply one re-entry permit at a time

2) Applying for another re-entry permit is going to take roughly the same amount of time to process as the first one did, which doesn't help your need for travelling back to the US soon to stay within the requirements of the original re-entry permit.

 

How "bad" is the  misspelling of your name?  Is it completely wrong and cannot be matched to the name on your green card in any way, or just off by one letter?

You must be in the US to apply for the permit---it cannot be done "third-party" from a different country/person.

1: i thought i need to apply for the second one before the first one expires

2: i don't have an immediate need to go back to the us

 

The misspelling of my last name was completely off. Also, I have already sent it back to USCIS as they instructed me to do.

If you apply for the second one, before the first one expires, you are required to send in the original (still valid) permit----that's what I meant by "you can only hold one permit at a time".  They require any still valid/about to expire permits to be submitted back to them for security reasons before issuing a new one...kind of like what a lot of countries do with passport renewals, when asking for the old unexpired one to be mailed back to them before processing the new one.

 

My suggestion right now would be to contact the US embassy/consulate where you are now and see if they have any info.
