Resubmitting a returned application

My wife's application for ROC was returned today citing insufficient application fee because we didn't include the biometric fee.  Now before people start saying I should've included that to begin with, let me cite the instruction:

 

Quote

2. U.S. Citizen or Lawful Permanent Resident Spouse. If you are the U.S. citizen or lawful permanent resident spouse, you do not need to include a biometric services fee at the time this petition is submitted. If USCIS later notifies you that you must submit your biometrics, you will receive a biometric services appointment notice with instructions on how to submit the additional fee.

 

Since my wife falls under the above category, we didn't include the biometric fee.  But, that's not the question here.  My question is I'm going to resend the application tomorrow and I was wonder if I should send the original application back or should I print out another copy of the completed form.  There are some writings on the original application, but I don't want to send that and get rejected again or not send that and get rejected for not sending the original application again.  Has anyone else had this experience before?

You can resubmit the package that was returned back along with the appropriate fee.

 

FYI, your wife does not fall under the category you qouted in your post. Your wife is neither a US citizen nor a Lawful Permanent Resident. What she is filing for ROC is to become a LPR.

 

if you look at the paragraph in the insteuction just above the one you cited, that’s your wife’s category and it cleary states biometrics fee is required.

Regarding the biometrics fee, I have to say sorry, but that's some selective reading. Read point #1, right above where you listed:

"Biometric Services Fee.

1. Conditional Resident. Each conditional resident and conditional resident dependent included in the principal petitioner’s Form I-751 is required to submit a biometric services fee with this petition, in addition to the required filing fee. (See the What Is the Filing Fee section of these Instructions.)"

 

That's the category that your wife falls into as she is a conditional resident submitting the petition.

 

You can resend the returned forms (assuming they are still the accepted editions, but I don't think they've changed recently).

Thanks for the info.  That was a really confusing statement, I went back and re-read it a couple more times along with everything else.... (-_-)

Its not selective reading.  The statement itself is somewhat misleading which is all too common in immigration documents.  I should've known better given the past process of getting her here.  Either way I'm resending the packet in the morning with the updated check.

Doesn't matter anyway, there's zero reason NOT to include the biometrics fee at the time of filing.

 

Either way, yes just send the original package back again , less work that way. No new print outs needed, but if there's extra proof you'd like to add this is a good oportunity for that.
